Dear Cheryl Knudsen,

On December 6, 2011 Rosemary Byrne and Carsten Thomsen from Public Health Seattle King County's Environmental Health Division visited Greenside Medical located in Seattle at 9804 Lake City Way NE in response to your inquiry regarding food being sold without a permit.Your concerns were addressed with the manager, David Ahl. Mr. Ahl showed the inspectors the retail area of the establishment which had a large variety of food for sale that contained medical marijuana (medibles).

On-site food preparation was not observed at this location. The retail area contained prepackaged labeled food that came from a variety of vendors. Packaged food that is not potentially hazardous is exempt from the food code and does not require a Public Health Seattle and King County permit. Although, the packaged food must still be processed in a licensed food establishment or food processing plant. You can view the food code at
Mr. Ahl was asked if he had any documentation showing that the food had been made in an approved commercial kitchen. He could not provide the required documentation at this time. Mr. Ahl was instructed to discontinue selling food until documentation could be provided showing that the food was from an approved permitted commercial kitchen.

The only product we saw at this facility that requires a Public Health Seattle King County (PHSKC) permit was frozen chicken fried rice. Since this pre-packaged product must be cold held, a PHSKC permit is required. Mr. Ahl was notified that in order to continue selling chicken fried rice Greenside Medical would need to go through plan review and permitting by PHSKC. Mr. Ahl agreed to discontinue selling this product as well as the other food products in his facility. He said he would contact the wholesale medible producers to determine if their products are made in an approved permitted commercial kitchen.

In your email you also asked if emplyees are required to have food worker cards. Food worker cards are not required for employees handling packaged food. Although, Mr. Ahl had copies of food worker cards for the employees working at this site.

We appreciate your concerns and for bringing this matter to our attention.

Hello, thanks for writing. It depends on what type of food the shop is selling. If they are just selling pre-packaged food such as chips, soda, candy bars, etc. that haven't been opened, they don't need a permit. The packaging will already protect the food from being contaminated. People need food business permits if they are selling freshly made food. If this is the case, let me know and we'll send an inspector to investigate.

This marijuana shop sells edible products. Are they required to have a permit? Are their employees required to have food handler permits?

Dear Cheryl Knudsen,

On December 6th, 2011 Public Health Seattle King County's (PHSKC) Environmental Health Division staff visited Greenside Medical located in Seattle at 9804 Lake City Way NE in response to your inquiry regarding food being sold without a permit. Your concerns were addressed with the manager, David Ahl. Mr. Ahl showed the inspectors the retail area of the establishment which had a large variety of food for sale. All but one food item being sold by the Greenside Market were exempt from the food code permitting requirements. We informed Mr. Ahl that he would have to stop selling the one item and at the conclusion of our visit, Mr. Ahl said he would discontinue selling that product.

You also inquired about whether the staff at the Greenside Market were required to have food worker cards. Since the foods they were selling were all pre-packaged, they would not normally be required to have them, however, Mr. Ahl did produce copies of food worker cards for the employees working at the Greenside Market.

We appreciate your concerns and for bringing this matter to our attention.

Sincerely,

Mark Rowe
