To Whom It May Concern:
Pursuant to the Kentucky Open Records Act, I hereby request the following records:
All applications for vegetation management submitted between January 1, 2023 and April 23, 2023, including the documents required by 603 KAR 5:155 section 3:
(a) A completed Application for Encroachment Permit, TC 99-1A form;
(b) A general description of work to be performed;
(c) A location map;
(d) A detailed and scaled drawing showing the location of the vegetation proposed to be removed or pruned;
(e) The name, address, and phone number of the contractor that will be performing the work;
(f) A signed release from property owners whose property lines front the right-of-way where the vegetation management is proposed;
(g) A signed consent from a private property owner that gives the applicant access from the private property to the work site;
(h) A seeding and erosion control plan pursuant to the department's manual, Standard Specifications for Road and Bridge Construction;
(i) Evidence of bonding maintained until released by the department; and
(j) Proof of liability insurance equal to or more than $1 million.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Kentucky Transportation Cabinet is in receipt of your Open Records request for permits issued in the District Five (D-5) area. As of the date of this correspondence no permit has been finalized and issued for vegetation removal within the D-5 area. KYTC will advise you that one permit application for this activity has been received but has not been approved and finalized, and is still in preliminary status. For this reason, KYTC will deny access to this preliminary permit application pursuant to KRS 61.878(1)(i) and (j). upon final action being taken, KYTC will release this permit to you upon further request.
