Thank you for your response. I am not surprised that your search using the following keywords (“Twitter”, “Facebook”, “Instagram”, “YouTube”, “LinkedIn”, “approval”, “drafting”, “deletion”, “@KYHealthAlerts”, “@chfsky”, “KYCHFS”, “KYDPH”, and “KY DPH”) yielded 76,154 emails; you interpreted this records request in a manner that was too broad and out of scope of the initial phrasing of the request, as I specifically asked for messages related to deletion on social media platforms. I was not consulted or asked for clarification regarding this request during your search for records.
Had I been consulted, I would have advised you narrow your search and NOT use platform names individually. Instead, better keyword pairings might have been, as these relate to the content of the request I filed with your office:

* ''twitter'' and ''remove"
* "tweet" and ''remove"
* ''twitter" and "inappropriate"

So, my question to your office is as follows: Is there a particular reason why you chose keywords that would intentionally yield thousands of requests, when it was not necessary to do so? It would appear that your office was intent on ensuring that you would have the opportunity to invoke KRS 61.872(6), instead of reading the letter of my request and in the case of confusion, consulting the requester (me).

The Cabinet fulfilled its responsibilities pursuant to the Open Records Act by its June 26, 2020 response to your open records request. The Cabinet’s June 26, 2020 response “constitute[d] final agency action” pursuant to KRS 61.880(1). Accordingly, the Cabinet will not respond further to your June 21, 2020 request. Should you disagree with the Cabinet’s response, you may appeal to the Kentucky Office of the Attorney General, as indicated in the Cabinet’s June 26, 2020 response.
