Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

Any and all written documents that include, but are not limited to, policies, procedures, training manuals, talking points and slideshows that include the topic of non-discrimination or anti-bullying policies regarding LGBT identified students. This includes, but is not limited to, policies on the use of restroom and locker room facilities. Please limit this request to documents that were generated over the past two years as well as documents, such as policies, that are in effect now.

Any and all communications or questions requested from education institutions regarding the Department of Justice’ 2016 Joint Guidance on Transgender Students (“Dear Colleague Letter”) or Trump’s 2017 “Dear Colleague Letter”. Any and all records, reports or documents sent to districts that regard student sexual health education.

Finally, I request any and all memos, letters, policies and guidelines sent to schools in the last five years that outline policies regarding transgender or gender non-conforming students. This includes, but is not limited to, the use of restroom and locker room facilities.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

According to agency staff, searching through all agency staff email accounts for the last two years using "transgender" as a search term results in over 4,000 hits. The time it will take to compile 4,000 emails and then reviewing them will be substantial. At $37.37 per hour, I want to be sure you want to spend the money it'll take to fulfill your request.
Are you looking for every single email that references the USDoE guidance on transgender students, or are you just looking for official statements/guidance documents provided to school districts from the Kansas State Department of Education?

In response to your updated request, I’ve attached three documents.

Minutes of the June 14th, 2016 Kansas State Board of Education which includes a formal policy statement issued by the State Board of Education.

A PowerPoint file used as part of a presentation on Title IX for the State Board of Education during its June 14th, 2016 meeting.

The Kansas State High School Athletics Association (KSHSAA) policy for transgender student participation. Although this policy was not specifically promulgated by the Kansas State Department of Education, it is available as a resource from the Department.

These are the only official statements or documents provided to school districts from the Kansas Dept. of Education in the last two years.
