From: Jesse Manuel

To Whom It May Concern:

Pursuant to the Colorado Open Records Act, I hereby request the following records:

Please forward all radio and dispatch records for a 1-mile radius from the intersection of Indiana Street and 52nd Avenue.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Jesse Manuel

From: Jesse Manuel

Please send for the time period January 23 to January 27 2017 all radio dispatch records and police report records for the area encompassing a 1-mile radius surrounding Indiana and 52nd Ave.

From: Lenore Aljinovich

Sir,
Your request for records/recordings was forwarded to my Records Unit for reply. The attached Application for Criminal Justice Records must be completed and signed prior to the processing of your request.

To help clarify:
- we must have a specific timeframe for your request
-The research needed for your request would require significant man-hours to search that particular radius and timeframe, then to locate applicable calls, listen and then download each call to CD.

The standard fee for a dispatch request, for one or limited calls to the same address, is $25, so considerable fees could apply. With a specific timeframe we can conduct a basic search to determine how many calls would be in the applicable radius you provide and we could then provide more detailed fees prior to actual processing.

Thank you,

Please forward police reports only for the time period January 23 to January 27 2017 for the area encompassing a 1-mile radius surrounding Indiana and 52nd Ave. The timeframe was provided to you folks on January 31 and on that date you indicated you could do a search and get back with how many reports this would encompass. Please send that count.

From: Lenore Aljinovich

Mr. Manuel,

Thank you for providing a more specific timeframe and I am working with Dispatch and our Crime Analysist to see the best way to provide the data. I apologize for the delay, but please see the following items to clarify your request.

1. I forwarded to you our required Application for Criminal Justice Records but I am not yet seeing a signed copy. This application form with signature for the pecuniary gain statement (that the documents shall not be used for the direct solicitation of business for monetary gain) is required before we can process your request.

2. Are there specific types of calls you are looking for? Do you want traffic, DUI stops, burglaries etc? that way only relevant calls will be provided.

3. There is confusion regarding your requests, what exactly is needed. Your initial request was for dispatch calls/recordings. Your follow-on request asks for case reports , counts? This was not part of your initial request and are handled by two separate sections: Dispatch Center and Records Unit.

4. Please submit the attached application, for either Dispatch calls or criminal justice reports. Both applications are attached and then add your specifics in order to clarify what it is you are requesting.

5. We will provide the data and based on that there will be fees assessed.

Thank you

I am homeless with no address and seeking only the police reports at this time because I cannot afford the $25 fee or the considerable fees you mention. The records will not be used for pecuniary gain and I'm shocked that you would think they would be.

From: Jesse Manuel

And to clarify further all police reports for all types of calls. I can't imagine there would be that many within a 1-mile radius.

From: Lenore Aljinovich

Sir,
We are certainly trying to help with your request and concerns with payment/fees. However, there still remains the concerns as listed below:

1. You must sign the attached application for criminal justice records per state statute 24-72-305.5. It is just the required practice for anyone requesting records from any law enforcement agency.

2. Dispatch printed a 102 page report for all calls between Jan 23-27. The next step would be a manual review to identify all calls within the 1 mile radius of the intersection of Indiana St and 52nd Ave. I have no idea how many calls their might be, but again, the issue being the time / manpower needed to review all calls on the 102 pages to properly identify the radius.

3. Next, for all / any calls in that radius, I would then need to review and print the reports and see what is or is not releasable. These actions all require time and fees.

4. I understand your concern with fees, but the stated fee for such 'manual type' research projects is $20 per hour plus $5 per report.

5. Is there a particular/limited timeframe and a particular type of report you are needing? We could more easily search by limiting the scope of your request and limit the associated fees.

** And we would need the signed application.

Thank you,

You should have the signed form, it was mailed to you directly.

I would like to inspect the 102 page printout you mention before requesting copies. Please send. I can pay for the first 5 pages at this point and will let you know which additional pages to print after inspecting the pages.

From: Jesse Manuel

Lenore, please what is the status on this? You have the signed form and hopefully all the other answers you need. Would like to inspect the 102-page printout as mentioned in the message to you on 3/7/17 and haven't heard back from you yet on that message. Status please and need the first 5 pages as requested on the 7th.

Thank you for your reply.

I received the signed application form in the mail Friday, March 10 by Mr. Jesse Manuel.

In the interim, I am coordinating with our Crime Analyst to provide a different report indicating incidents in the area of your interest. This report should list reports taken during the timeframe requested. There will be a $3 fee required. I should have the report to you tomorrow.

And again, for my understanding, I am working with Mr. Jesse Manuel in this matter? He signed the application form, and he must be aware of fees and be agreeable to what we are providing as there has been considerable research and manpower towards his request.

From: Lenore Aljinovich

Mr. Manuel,
After coordination with our crime analyst, her report would come from our website - crime mapping.
Sorry I did not think of this as an option much earlier. Our crime mapping is used by so many to identify the areas they are concerned with, and also find a listing of incidents. From there, you can find and request the specific report/s you are interested in and save money and manpower as used already to try to pinpoint what you are actually looking for.

Please see our website at www.jeffcosheriff.com<http://www.jeffcosheriff.com> under Crime then crime mapping.
Explore by the area you are interested in, find the 1 mile radius you mentioned and then you can
send in the application form to me with the exact report you need.
Reports if released are $5.00 for the first 10 pages and .25 each additional page.

Thank you,
