To Whom It May Concern:

Pursuant to the North Carolina Public Records Law, I hereby request the following records:

In 2017 Dave Cloutier being "Giglioed" and evidence being mishandled compromised the pending Eighth Judicial District Court cases Wayne, Greene and\or Lenoir counties and possibly surrounding cities, counties such as Durham, NC. Therefore, specifically we seek from the district attorney Matthew Delbridge; the NC SBI, and\or Federal Bureau Investigation\DOJ:
1. Copy of "any and all" 2013 to 2018 cases, case numbers, named defendants that were impacted by VICE officer Dave Cloutier investigation cases in questioned; and regardless of charges filed, or dismissed as result of Giglio;
2. Copy of "any and all" 2014-2017 investigative notes taken by Cloutier against or relates to the victim\Defendants;
3. Copy of "any and all" names of associated police officers, FBI Agents, Goldsboro police FBI liaisons that "may have" worked with officer Cloutier as they relate to the Giglio;
4. Copy of "any and all" August 2014 to June 2017 Cloutier generated "internal and\or external emails"
5. Copy of any and all emails directly from FBI to\from Cloutier, and\or to\from Jeffery Stewart Police Chief; and Major Mike West.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In response to the items listed below and requested pursuant to the North Carolina Public Records Act, the Office of the District Attorney for the Ninth Prosecutorial District states as follows;

Item (1) - There is no such list or lists pertaining to this request and it is the stated position of the Office of General Counsel for the North Carolina Judicial Branch that nothing in the public records law requires the office of a District Attorney to create or compile a record that does not exist.
Item (2) - The information requested is considered a "record of criminal investigation" as that term is defined in N.C.G.S. 132-1.4(b)(1) and is not a public record under the North Carolina Public Records Act.
Item (3) - There is no such list or lists pertaining to this request and it is the stated position of the Office of General Counsel for the North Carolina Judicial Branch that nothing in the public records law requires the office of a District Attorney to create or compile a record that does not exist.
