Pursuant to the Missouri Sunshine Law and the Missouri Public Records Law, I hereby request the following records:

All reports authored, co-authored, submitted, or approved by Officer Darren Wilson of Ferguson Police Department in August of 2014. This is the man widely reported to have committed homicide of Michael Brown on August 9, 2014.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Please be advised that due to the scope and nature of the request, the fact that records are kept in different locations and in different buildings and the limited resources of the City at this particular time, it will take longer than three (3) days to research the records that may be responsive to the request, retrieve and gather those records, determine if the record contains any closed or confidential information, redact any closed or confidential information and either scan or copy the records.

Based on initial review of the request and without knowing the extent of the documents that may be responsive to the request, I estimate that the earliest date that such documents may be retrieved is October 3, 2014.

I have attached to this email an incident log showing all calls for service during the time period you requested. Officer Darren Wilson is identified on the logs as 609. It may help narrow the scope of your request if you would like to look at this log and identify which reports you would like to receive copies of. If you would like all of the reports for the requested time period, I can still process your request accordingly, however, we would require a deposit of $100 before proceeding with the work.

There is a tremendous amount of work involved with each report. First, each report must be retrieved and redacted of simple information such as social security numbers. Then, each subject, arrestee, or defendant mentioned in the report must be researched; in the event that such subject, arrestee, or defendant was placed on SIS probation or if the case was dismissed, then much of that record will be closed. In addition, each offense or event described in the reports must be researched; in the event the report is part of an active investigation, then portions of the report may be a closed record. The City Attorney's assistance is required with regard to determining the extent to which certain information should be redacted.

I received your e-mail of October 1, including a PDF containing images of a paper copy of an event report. I am unable to search this document for "609" because you inexplicably went to the trouble of printing and scanning the report instead of simply forwarding it to me in its native electronic format.

I don't understand why you request that I perform your search for you. Presumably, records I requested are in a department database, retrievable by employee name or other identifier.

And I suspect that searches for these records have already been performed by staff at your department. Mr. Wilson is widely known to be the man who murdered Michael Brown in August of this year, and this situation has generated a great deal of interest from reporters, police accountability advocates, the United States Department of Justice, and the general public. I suspect that providing the records I requested will be as simple as asking your colleagues for "the Wilson documents," attaching those to an e-mail message, and pressing send. The cost of such work is de minimus.

Phil,

I am assisting in responding to Sunshine Law requests while the Custodian of Records is out of the office.

I have researched the events log for the time period of August 1, 2014, through August 9, 2014 (which is the last day that Officer Darren Wilson worked).

I found 30 separate events during that time period which involved Officer Darren Wilson.

I have researched 17 of those events so far.

Out of the 17 events that I researched, ten events were of a such a nature as not to require a written report and, therefore, there is no written report associated with those events.

I retrieved seven reports for the remainder of the 17 events that I researched.

I redacted social security numbers from those reports.

The total time that it has taken for the research, retrieval, and redaction so far is 1 hour and 55 minutes. The total cost for the seven reports retrieved so far is $26.45.

Payment is required before receipt of the records. Please submit your payment in the form of cash, money order or cashiers check the Finance Office, 110 Church Street, Ferguson, Missouri 63135. Please reference the email address with your payment to ensure proper credit of the payment.

Once payment is received, the City will send the seven reports retrieved so far to the above email address.

Also, once payment is received, I will research the remaining 13 events to determine if written reports are associated with those 13 events. When that work is completed, payment for that additional work will be required at the time of completion.
