Personnel and internal affairs records pertaining to former assistant chief Wayne Welsh.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. O'Connor,

My name is Joy Rabalais. I have been retained by the Village of Estherwood to make formal response to your recent public records request, where you asked for documents regarding the personnel and internal affairs records pertaining to former assistant chief Wayne Welsh.

First, an officer's personnel records are exempt from disclosure under the Louisiana Public Records Act. See East Bank Consolidated Special Service Fire Protection District v. Crossen, 04-838 (La. App. 5th Cir. 12/28/2004), 892 So.3d 666, writ denied, 897 So.2d 608 (La. 4/1/05) and La. R.S. 40:2532, which hold that public employees have a reasonable expectation of privacy in their personnel records.

However, in the spirit of cooperation, we have located and attach hereto a copy of the Minutes from the Village of Estherwood's board meeting where the employment of now Chief Welsh was discussed in 2017, as well as Chief Welsh's August 4, 2017 resignation letter, which was denied by the Council on August 17, 2017

With regards to your request for any Internal affairs records regarding Chief Welsh, please note that I have been advised that when the former Chief left office, he took several items with him; however, Chief Welsh is making contact with the former Chief to inquire as to any documentation that he may have responsive to your request. Therefore, this response will be supplemented as soon as I hear back from Chief Welsh as to whether he had any success locating any such documentation.

Mr. O'Connor,

Chief Welsh advised that he has spoken with former Chief and inquired as to whether the former Chief had an Internal Affairs or investigative file regarding the Facebook incident. Outside of the Chief's resignation letter and the Board Minutes previously produced, the former Chief did not keep any other documentation regarding the incident.
