Pursuant to the Section 902(a) of the Right-To-Know Law, the Edinboro University’s OOR requires an additional 30 days to respond because:

1. A timely response to the request for access cannot be accomplished due to bona fide and specified staffing limitations.

2. The extent or nature of the request precludes a response within the required time period.

This Agency expects to respond to your request on or before December 1, 2021.

To help serve you better, Edinboro University seeks clarification regarding your request.

Is there a specific timeframe that you would like us to provide contracts/agreements and invoices for items #1, #2, #4, #5, #7, #8, #10, and #11 below?

Also, for items #13 & #14, is there a specific timeframe you would like for communications with Ryan Williams and anyone at CCI?

Lastly, in items #13 & #14 when you state, “All Your Communications,” is there a specific individual at Edinboro University you are referring to?

The RTKL request is granted in part and denied in part. There is no fee for electronic data.

Items 1, 2, 3, 13, and 14:

The responsive records contained therein are redacted to the extent that information is exempted from disclosure under the RTKL; see Section 708(b)(6): record containing certain personal identification information; see Section 708(b)(28)(i): a record of information identifying an individual who applies for or receives social services.

Additionally, On July 1, 2020, Act 50 was signed into law by Governor Wolf with immediate effect. Act 50, specifically 24 P.S. § 20-2021-A, was added to the Public School Code and the addition excludes student education records as defined by FERPA from disclosure under the Right-to-Know Law.

The University also redacted information that is a not a record of the agency, as it that does not document a transaction or activity of the University. See. 67 P.S. § 67.102 (See definition of “record”). The redacted information is personal information exchanged between students/potential
students and Edinboro University and/or Condensed Curriculum International.

Item 3:
After a good faith effort to locate any records, Edinboro University does not have any records responsive to “payments received from CCI” in its possession, under its custody or its control. As of the date of this letter, no payments from CCI were identified.

Pursuant to the Office of Open Records Final Decision in Jenkins vs. Pennsylvania Department of State, OOR Dkt. AP 2009-065, it should be noted that: "It is not a denial of access when an agency does not possess records and [there is no] legal obligation to obtain them (see, e.g. section 67.506 (d)(1))."

Items 4, 5, 6, 7, 8, 9, 10, 11, 12:
After a good faith effort to locate any records, Edinboro University does not have any records responsive to this portion of your request in its possession, under its custody or its control.
