Hi Lt Babetski,

I am following up on this request because we are approaching the deadline. I also sent a second request which hasn't received a response yet. That request was entitled "Police Inventory Lists (East Brandywine Police Department)." Please let me know if you require any clarification.

Best regards,

Lt. Babetski,

I apologize, I had no idea you are recovering from surgery. I hope you are doing well. Please do not be concerned about my request, just get better.

Godspeed,

Mark Cottell

From: Gene Babetski

Mr. Cottell,

Attached the information that we have to provide. Honestly, I have never heard of a "StingRay" tracking device. Sincerely, Lt Babetski

From: Mark Cottell

Lt. Babetski,

Thank you for working on this request. For the following items:

1. All information regarding non-lethal weapons they have had in their possession for the past 3 years.
2. All information pertaining to the possession and use of Stingray tracking devices for the past 3 years.
3. All information regarding the use of contractors including those hired by DHS in conjunction with East Brandywine Police Department for the past 3 years.

...I received the response: “Exempt under section 708.” There are many specific subsections under Exemption 708. Which of these are you citing for each of the 3 requests? For example: Exemption 708 (6)(ii) or Exemption 708 (7)(ix). It appears as if there is information for these requests that isn't being released. Clarification for the reason the exemption was cited would help determine my next steps.

I appreciate your time and patience.

Best regards,

Mark Cottell

To whom it may Concern,

You mention that this request was fulfilled at a precious date but it is your opinion that the response was inadequate. If you are willing to provide me the prior response I will review it and attempt to clarify any concerns. If this if not an acceptable route then I would urge you submit a new request and I will fulfil it as required by the Pennsylvania Right to Know Act. At this time I am closing your current request (below) as you acknowledged it was fulfilled by a previous RTK Officer at a previous date.
