From: Christopher Schiano

To Whom It May Concern:

Pursuant to the Colorado Open Records Act, I hereby request the following records:

All emails, letters and other communication dated from December 12, 2014 to December 16, 2014 between RTD employees and any employees of the Denver Police Department or the City of Denver regarding protest activity on December 13, 2014.

To help clarify my request and provide context for the records custodian, here are some various online links relevant to protest activity on this date:

During this December 13 protest march, a protester named Alex Bender was arrested on RTD property on or near Union Station. DPD officers also told protesters that they were “on private property", assumed to mean RTD property. Please understand my request to include, but not be limited to, any communications made between December 12, 2014 and December 16, 2014 between RTD and the Denver Police Department or the City of Denver regarding the arrest of Mr. Bender, charges filed against Mr. Bender, the presence of protesters on RTD property, or the coordination of RTD staff (or RTD contractor staff) with the police department's response to protests.

Please also understand my request to include, but not be limited to, any emails in RTD databases which were received from or sent to any email address ending in @denvergov.org between December 12, 2014 and December 16, 2014 which contain the words "protest" "protester" or "protesters".

If you deny this request for records in whole or in part, I ask that you provide a written statement explaining the reason for the denial that cites the legal authority that is the basis for the denial. If any of the requested records are in active use, in storage or otherwise unavailable at this time, I likewise request that you provide a statement informing me of the reason they are currently unavailable and a date and hour at which time the records will be available for inspection.

I also request that fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Christopher Schiano

Tina,

I just delivered payment in person to RTD offices at 1600 Blake. The check was made out for $60 and included the reference number as per your instructions. The RTD employee at the front desk was very helpful and gave me a note with a timestamp as proof of payment. Please let me know if you need me to provide proof of payment.
I look forward to my request being processed. Thank you very much.

Sincerely,
Christopher Schiano

Hello,
The check we received from you is not signed. Can you come back and sign the check or provide a signed check?
Thank you.

From: Christopher Schiano

Yes I will deliver a signed check to your office as soon as possible. My apologies

Thank you.

Tina,

I was hoping to drop off a signed check in person this week, but it looks like I will be busy. A *signed* check to RTD for the CORA request fee is now in the mail. Please confirm receipt of my check or let me know if you don't receive it in the next few days. I apologize for my mistake and for the delay. Thank you for your patience.

sincerely,
Christopher Schiano

Hi Tina,

I will swing by shortly to pick up the cd. Is there a way the files can be emailed for this request as well? The intention is for all material to be freely available to the public online at Muckrock.com as open journalism.

Thanks for your help,
Chris

From: Christopher Schiano

Tina,

I have a clarifying question/concern about an email found in the records produced in response my request (thank you for leaving the CD for me to pick up).

My question/concern is in regards to an email sent from jwilson1022@comcast.net on 12/16/2014 3:34:07 PM with subject "Fwd: Words of a dying black man (strong language)". This email appears to be a chain letter email with a negative message about Mike Brown, the teen killed by police in Ferguson, MO last year. The "To" field in the email is blank, so it is not clear which RTD or city employee sent or received this message, although I assume since this email was included in records responsive for my request that it must have been forwarded or received by an employee of RTD, or of the City of Denver.

Can you please confirm that this email address was redacted in this record or explain why the "To" field in this email is blank in the data I received?
If in fact this email address was redacted, please cite the legal authority which authorizes you to withhold this information.
Alternatively (and preferably), please identify the email address and name associated with RTD or the City of Denver which forwarded or received this email.

thank you for your cooperation.

sincerely,
Christopher Schiano

Hello,

I send a response to this yesterday. Did you not receive it? I am a little confused because the email addresses for your requests has been different.

I have this address: requests@muckrock.com<mailto:requests@muckrock.com> and this one requests@muckrock.com<mailto:requests@muckrock.com>

Thank you.

From: Christopher Schiano

Tina,

This seems to be an automated follow-up. Please consider this request to be satisfied. The only reason this request is not flagged as 'Complete' on Muckrock is because we are waiting to resolve some technical issues regarding posting all the responsive records online. I apologize for any confusion and thank you for being so helpful in responding to this request.

Chris
