Hello David,
Denver Parks and Recreation is in receipt of your Colorado Open Records Act (CORA) request dated February 1, 2021 and received in our office on February 24, 2021. I'm reaching out to you today to seek clarification so as to better help us create our estimate of time needed to fulfill your request. In your request, attached, you list several dates for emails of Eliza Hunholz followed by "should be given first." Is this meant to be a list of specific dates that you are seeking emails containing the list of keywords or is there a specific range of dates to these emails you have requested? Also, are you seeking emails sent by Eliza Hunholz or to Eliza Hunholz, or both?
Once we receive your response we will create our estimate of time needed to fulfill your request and respond within three business days with our estimated cost to produce these records.
Best,
Arthur Gilkison

Hello,

I am sorry, I failed to send my response. Those dates are the list. I’d say 3 days before and 2 days after for the search. I’m looking for emails to and from.

Thanks,
David

Mr. Hagan,

The Department of Parks and Recreation (“Parks”) is in receipt of the refined open records request you submitted on March 23, 2021. Parks has in its possession documents responsive to your request and estimates that it will take approximately 7-hours to gather, review and compile the responsive documents.

The Colorado Open Records Act (“CORA”) requires the first hour of staff time spent researching and retrieving documents to be free and permits records custodians to charge $33.00 per hour for additional time. C.R.S. § 24-72-205(6)(a). Consequently, Parks estimates that responding to your request will cost approximately $198.00. Should this process take less time than estimated, Parks will issue you a refund. You may send a check or money order made out to the “Manager of Finance” to the address listed below.

Denver Parks and Recreation
Attn: Arthur Gilkison
201 W Colfax Ave Dept 601
Denver, CO 80202

Once Parks receives payment, we will begin gathering the responsive records. Please let me know if you have questions or wish to refine your request in any way.

Thank you,
Cyndi

Hi,

I know that you are able to wave the fees on a case by case basis and I would like to request that the fees are waved for this request. I lost my job due to covid and do not have extra income. If you don’t want to wave the fees is there any chance that you can discount them? It would be much appreciated.

All the best,
David Hagan

Let’s start with the lincoln park sweep from last year and go from there. That should cover one hour of work. If I find it to be helpful I will pay. If it takes less than one hour I would like you to start with Arkins. So 7.29 then 11.30

Thanks,

Mr. Hagan,
We are in receipt of your refined CORA request. Limiting your request to Lincoln Park will take more than one hour of work to complete. We would also require payment before we perform the work as consistent with our policy. Combining your request would be the most efficient and therefore most cost effective path forward. Please let me know how you would like to proceed I can provide you a cost estimate for your request.
Best,
Arthur Gilkison

Hi Arthur,

I would like an hour spent on Arkins. I know how the system works. It will take less than 5 minutes to pull Arkins emails. That leaves you 55 minutes for staff to read and redact. Combining doesn’t do much of anything. I used to manage a very large org with 1300 team members and another 1000 contracted. Microsoft makes it very easy to search the system. If you would like I would be happy to show you how to do it.

David

Mr. Hagan,

Denver Parks and Recreation (“Parks”) is in receipt of your refined CORA request. Parks has determined it will take approximately 3 hours to provide the requested records related to Arkins Court. Under Colorado law the first hour of research is free and each subsequent hour is charged at a rate of $33 per hour for a grand total of $66 to complete this refined request. Once Parks has received your payment we will begin gathering responsive records. If we find that it takes less time, we will issue you a refund for the difference. You may send a check or money order made out to the “Manager of Finance” to the address listed below.

From: Parks And Recreation Denver

Mr. Hagan,
Denver Parks and Recreation is in receipt of your response to our estimate of time and cost to complete your request. The 3 hour estimate provides for a complete response to the request, which is required under CORA, including review by management and legal staff. You are free to further refine your request in an effort to save time and cost. Otherwise, we will begin the process once payment is received, and we will refund you for any time that is not used.

Arthur,

I am amending my CORA, I am requesting that Parks provide me whatever they can for no cost. I am not in a place where I have any money that I can spend on this. Whatever time you can spend without charging me is what I request.

Now that that is out of the way, you can provide me with a complete response to my CORA request and you will be following all requirements of CORA.

All the best,
David
