I am amending my request in light of the impact voiced by Patrick Coleman at Oct. 10 City Council meeting to include metadata and not contents, for the time being, to aid his office in performing their diligence with less time required.

Pursuant to the Freedom of Information Act, I hereby request the following records:

I am writing to request metadata relating to emails sent To, From, CC, or BCC the following accounts:

sundog2014@yahoo.com - Teri Park, advisory member of Parks and Rec board

Please provide me the following information for all emails sent from Jan. 1 2018 to the present to/from/cc/bcc the above-listed accounts:

2. To address
3. bcc addresses
4. cc addresses

7. Subject

Please note that I am not requesting the contents of each email.

I am more than happy to provide documentation or tips for extracting this information from your mail server if needed. Google's Vault tooling should make this request straightforward to complete. E-mail metadata is trivially exportable from the IT infrastructure of any modern e-mail archiving or data retention system - such as Microsoft Outlook 365, Google, Datacove, etc. - and should be deliverable in a .CSV, .XLS, or other machine readable format.

Please note that I am not requesting the contents of each email. E-mail metadata does not include the contents of the specified e-mails, thus do not need individual review for redaction.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

The City of Cortez adopted Resolution No. 26, Series 2022, to implement the Colorado Open Records Act, C.R.S. § 24-720201.1, et seq. (“CORA”). CORA allows the City to make reasonable rules and regulations concerning the copying and inspection of public records. One of the rules the City requires is that a person or entity that desires to request public records from the City must complete the City’s standard CORA request form, a copy of which is attached. Any person or entity may submit a CORA request using the proper form. Please find attached the form which is required for a CORA request for the City of Cortez. Thank you.

Although the Amended Request was submitted “Pursuant to the Freedom of Information Act,” which is not applicable to the City of Cortez, and the request requested emails from or to “Teri Park,” the City assumes that the person’s last name was a typo and the correct name to search is “Teri Paul,” who is a current member of the City’s Parks, Recreation, and Forestry Advisory Board, the City is processing this request pursuant to the Colorado Open Records Act, C.R.S. § 24-72-200.1, et seq. (CORA), and will search using the name of Teri Park. A search of the requested metadata and the staff time to review the documents to ensure that no statutory exceptions exist preventing the release or requiring the redaction of the documents, is estimated to take a minimum of three hours. Pursuant to CORA, there is no charge for the first hour, and every hour thereafter is charged at $33.58 per hour, for an estimated minimum fee of $67.16. Please provide payment to the City Clerk’s Office of 50% of the estimated fee, or $33.58 to allow the City to begin processing your request. The City is extending the time to respond to this request due to the extenuating circumstances, including the City having to devote all or substantially all of its resources to meeting an impending deadline concerning another CORA request, the uncertainty of the name search, and the uncertainty of the statutory basis for the records request.

The email address provided allows a failsafe for the identity of the individual, and hopefully the search will return both Teri Paul as well as the sundog2014@yahoo.com identified through a previous FOIA as belonging Teri Paul, advisory member of Parks and Rec board.

Thank you for the PDF copy. As per the original request I have two questions.

1) Is it a typo that the first hour was charged? I was under the understanding the first hour was free. Please categorize the time required to handle this, and what staff by name and department were involved because the output requested was trivial and not meant to have to be output as a page within a PDF, along with the time to screen three pages. $33 seems excessive to review three pages as produced.

2) The original request stipulated an electronic format if possible. "E-mail metadata is trivially exportable from the IT infrastructure of any modern e-mail archiving or data retention system - such as Microsoft Outlook 365, Google, Datacove, etc. - and should be deliverable in a .CSV, .XLS, or other machine readable format." Is it possible to have this file uploaded within the email rather than the PDF output? If not, please explain why this is not possible.
