Attention Charles Jeter.
Regarding your records request, I have attached our records request form.
As soon as I get the filled-out form back I can email you those calls/reports.
Am I understanding your request correctly that you are also wanting the calls/audio that went to our dispatch center? If so, please put that on the form as well. Just so you are aware I believe calls/audio records only go back 3 years.
Thanks,

Thank you Taylor. I appreciate your amplification on the call matter. Let's separate this slightly more to make it easier.

1. Call 23017731 - Please provide details and records on any other calls, investigations, reports, logs, notes, bookings or contact reports, complaints or other data for Police Department or Sheriff's Office to the Carpenter Wilderness trailhead area, the addresses adjacent to or bordering 1050 Lebanon, or responses that were made within 400 yards either side.

2. Aside from the above call, please provide details and records on any other calls, investigations, reports, logs, notes, bookings or contact reports, complaints or other data for Police Department or Sheriff's Office to the Carpenter Wilderness trailhead area, the addresses adjacent to or bordering 1050 Lebanon, or responses that were made within 400 yards either side. This should extend back to January 2020 from the present, or as much archive as you typically maintain.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not. The law states, Section 24-72-205 (5) (a), C.R.S., (a) A custodian may charge a fee not to exceed twenty-five cents per standard page for a copy of a public record or a fee not to exceed the actual cost of providing a copy, printout, or photograph of a public record in a format other than a standard page; except that a custodian shall not charge a per-page fee for providing records in a digital or electronic format. I would request that these be provided in digital format via the Muckrock request rather than printed out.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Charles Jeter

This sentence was somehow omitted in my correction.

The audio for Call 23017731 should in fact be included as well as any officer camera footage, as well as any audio from calls made on the same issue or in the same vicinity during the same 24 hour period.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

A couple more questions. You state "Aside from the above call, please provide details and records on any other calls, investigations, reports, logs, notes, bookings or contact reports, complaints or other data for Police Department or Sheriff's Office to the Carpenter Wilderness trailhead area, the addresses adjacent to or bordering 1050 Lebanon, or responses that were made within 400 yards either side. This should extend back to January 2020 from the present, or as much archive as you typically maintain." are you requesting every single record we have at those locations or just records related to a certain incident? If you are requesting every record that will take much longer than the 3 days as I will have to go through each record individually.
If your requesting records for a certain incident, do you have names/parties involved that could make this request easier to complete?
Thanks,

Hi Taylor,

Thank you so much for the patience and detail oriented attention to this request. IF we could get the first part of the request accomplished, the second one is fine to take more than three days, particularly during the holiday period we are entering.

1. Call 23017731 - Please provide details and records on any other calls, investigations, reports, logs, notes, bookings or contact reports, complaints or other data for Police Department or Sheriff's Office to the Carpenter Wilderness trailhead area, the addresses adjacent to or bordering 1050 Lebanon, or responses that were made within 400 yards either side on or around that date and time. -- this one is important, and yes I would like a copy of the audio and if there was any officer camera footage, please archive that and let me know the cost.

2, This call may have occurred the same day from multiple parties, or there may have been other complaints filed nonemergency which is why I wanted other information about the vicinity geographically about the park. Because there is a potential for Carpenter Trails to be considered an 'attractive nuisance' I was curious about establishing a baseline of complaints and complaint types for the vicinity of the trailhead, the park, and also the 1050 Lebanon Rd. address. I am familiar with geofencing and use of ArcGIS / QGIS for establishing a query based on geography so I requested a buffer around the park of 400 yards for the calls. It's perfectly okay for this part of the FOIA / CORA to take longer than three days, and in fact, I would say that I expect to hear "The Cortez Police Department is extending the time to respond to this request due to the extenuating circumstances of searching for the data requested through a geographical reference method across several years in time..." with an estimate if possible to set expectations.

So, for part 2 no issues with it taking a reasonable amount of time to research. With part 1, if we could expedite the audio recording of the initial call in from Rachael Marchbanks on April 29, 2023, Call 23017731, I would be ever so grateful because it would expedite my research and query into the matter. It's okay to provide updates as they come in rather than simply await it all to be aggregated, in fact I would appreciate it being provided via digital as you obtain it.

Thanks in advance,

Charles Jeter

Charles,
I have attached the Cortez Police Department's request for records form again. I do need that form filled out before completing any requests you have.
Please include on our request form that you are needing dispatch audio/calls and officer bodycam, along with call notes/reports.

For the first part of your request, I can get you the call notes/report as soon as I get our request form back. The audio and bodycam request will go to the dispatch supervisor and patrol secretary, again, as soon as I get the form back, I will get the request sent to them.

I will get back with you next week regarding the second part of your request.
Thanks,

Hi Taylor,

I reviewed the form with MuckRock, the nonprofit outlet that I am processing these requests through. If this has nothing to do with an accident report, would the policy preclude omitting the requestor's personal identifiers such as DOB and Driver's License? Please check on this to ensure that there is no statute that precludes release of information to media without personally identifiable information also being released of the requestor.

If we are able to eliminate this requirement, I can get MuckRock to finish the form fillout and we can proceed.

Thanks, Merry Christmas,

Charles
