To Whom It May Concern:

Pursuant to the Colorado Open Records Act, I hereby request the following records:

1) All contracts and statements of work (including addendums) between the department and Deloitte and/or Deloitte's subcontractors or licensees regarding provision of the MyUI+ unemployment fraud detection system. This partnership has been publicly announced: https://www.denverpost.com/2021/01/12/colorado-labor-department-new-unemployment-claims-system-problems/.

2) Documentation of the predictive model(s) built by Deloitte and/or Deloitte's subcontractors or licensees for unemployment fraud detection. This should include, where possible, an executive summary of the model, a list of the variables the model considers, how those variables are weighed by the model, explanations of the machine learning techniques employed, the results of accuracy validation tests, and the results of disparate impact tests.

3) A de-identified data set containing all unemployment claims flagged as potentially improper/fraudulent by the MyUI+ predictive model(s) from the time the system was implemented until the present date. Please note, that I am requesting this dataset not contain data fields that are personally identifiable (e.g., name, street address, SSN).

4) A de-identified data set containing all unemployment claims NOT flagged as potentially improper/fraudulent by the MyUI+ predictive model(s) from the time the system was implemented until the present date. Please note, that I am requesting this dataset not contain data fields that are personally identifiable (e.g., name, street address, SSN).

I ask that all fees be waived as I am a journalist and intend to use the requested records to publish articles in the public interest. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of it, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Todd Feathers

Your November 4, 2021 CORA request for Colorado unemployment fraud system
information can only be fulfilled by providing you the contract with
Deloitte (item 1).

Item 2. Providing that information would expose our fraud analytics
methodology and fraud hold types which needs to be held as doing otherwise
would expose the mechanism by which persons attempting fraud could be made
aware of and used to avoid detection. Therefore under C.R.S.
24-72-204(2)(A)(I) that information will not be provided.

Under the State Attorney General's guidance of 2001, the Open Records Act
only makes public written information that already exists within the
government. It does not force an agency or other government organization
involved to create new records to respond to a request. It also does not
require the government to manipulate or analyze information it might have
in a new way in order to respond to a request.

- Item 3. The division does not maintain a record showing all
unemployment claims flagged as potentially improper/fraudulent.
- Item 4. The division does not maintain a record showing all
unemployment claims NOT flagged as potentially improper/fraudulent.
