To Whom It May Concern:

Pursuant to the Tennessee Public Records Act, I hereby request the following records:

1. Any guidance, policies, or training concerning or mentioning enforcement of speeding, the hands-free law (including references to "distracted driving", "hands-free", or "hands free"), or Tenn. Code §§ 55-8-152 (speeding), 55-8-153 (speeding), 55-8-199 (hands-free law), 55-10-207 (citation in lieu of arrest), or 40-6-215 (arrest warrants). This request is limited to currently-applicable guidance, policies, or training.

2. Any statistics maintained by your agency which concern the rate of stops, citations, or arrests for moving violations, speeding (including Tenn. Code §§ 55-8-152, 55-8-153), or distracted driving (including Tenn. Code §§ 55-8-199). This request is limited to statistics generated on or after January 1, 2018.

3. A copy of any (a) incident report, (b) warrant application, (c) warrant affidavit, or (d) warrant where the report, application, affidavit, or warrant involves or seeks an arrest (not citation) for speeding or the hands-free law, including any violation of Tenn. Code §§ 55-8-152, 55-8-153, or 55-8-199. This request is limited to reports, applications, affidavits, or warrants generated on or after January 1, 2018.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

1. CPD General Order 93-08, Traffic Enforcement is attached.
2. Citations and arrests where 55-8-152 and 55-8-199 was used. We do not use 55-8-153 that I could find. The file name starts with the year, then the charge. If someone was arrested and the charge was one of the charges (152 or 199) in the arrest, the file name has arrest. Also, due to a ransomware attack in 2019, we do not have 2018 and half of 2019 that could be quickly accessed. This would take extensive time to research.
3. This request would take extensive time to research as this is not tracked for statistical purposes.
