Based on the your request for "A copy of any (a) incident report, (b) warrant application, (c) warrant affidavit, or (d) warrant where the report, application, affidavit, or warrant involves or seeks an arrest (not citation) for speeding or the hands-free law, including any violation ...", there are at least 600 reports of which we estimate that it will take around 60 hours of review in order to not only decide which reports fit your request, but also to review and redact the reports as required under Tennessee law. I apologize for the confusion. No, there are not necessarily 600 incident reports where an arrest is sought, but there are 600 reports that involve speeding or the hands-free law. We would need to review each report to find those that do involve or seek an arrest, if there are any. As for your second question, I do not see a way to narrow the request to avoid the review of those reports because we will have to review each report, but I am open to working with you if you have any suggestions. Request Description: To Whom It May Concern:

Pursuant to the Tennessee Public Records Act, I hereby request the following records:

1. Any guidance, policies, or training concerning or mentioning enforcement of speeding, the hands-free law (including references to "distracted driving", "hands-free", or "hands free"), or Tenn. Code §§ 55-8-152 (speeding), 55-8-153 (speeding), 55-8-199 (hands-free law), 55-10-207 (citation in lieu of arrest), or 40-6-215 (arrest warrants). This request is limited to currently-applicable guidance, policies, or training.

2. Any statistics maintained by your agency which concern the rate of stops, citations, or arrests for moving violations, speeding (including Tenn. Code §§ 55-8-152, 55-8-153), or distracted driving (including Tenn. Code §§ 55-8-199). This request is limited to statistics generated on or after January 1, 2018.

3. A copy of any (a) incident report, (b) warrant application, (c) warrant affidavit, or (d) warrant where the report, application, affidavit, or warrant involves or seeks an arrest (not citation) for speeding or the hands-free law, including any violation of Tenn. Code §§ 55-8-152, 55-8-153, or 55-8-199. This request is limited to reports, applications, affidavits, or warrants generated on or after January 1, 2018.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
