Pursuant to the North Carolina Public Records Law, I hereby request the following records:

Any and all records from the past two years (August 2021-August 2023) regarding your nuisance property ordinances that will be referred to as "ordinance" in this request but could be known (but not limited to) as "Residential Rental Registration and Remedial Action Program" as described in Sec. 6-580-Sec. 6-590.

Please provide any and all written records (including but not limited to hard-copy documents, memos, emails, word processor documents, PDF documents, PowerPoint files, images files, video files etc.) regarding the Ordinance including but not limited to:

• any training/presentation materials used in communication, promotions, workshops, seminars, etc

• criminal background checks performed on prospective tenants

• evictions filed by property owners and number of tenants evicted as a result of the ordinance

• suspensions or revocation of a residential rental license, against property owners who fail to comply with the requirements of the ordinance

• police calls, reports, citations, or arrests, collected by the municipality police department for the purpose of enforcing the ordinance

• meeting minutes and correspondence between municipality officials, regarding the implementation and enforcement of the ordinance

• all documents concerning the passage of the nuisance ordinance and any amendments to it, including communications with City elected officials, city staff, and others, and any data relied upon or reviewed as a part of the passage or amendments to the nuisance ordinance since August 2021 to August 2023.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for your public records request (#10590) seeking records for the past two years (August 2021-August 2023) regarding the City of Charlotte's property ordinance. Please refer to the responses provided directly below to your seven requests for information.

1. Any training/presentation materials used in communication, promotions, workshops, seminars, etc.
* There are no responsive records to request #1 pertaining to training/presentation materials used in communication, promotions, workshops, seminars, etc., for the timeframe August 2021-August 2023.
2. Criminal background checks performed on prospective tenants.
* Criminal background checks performed on prospective tenants are conducted by rental property owners, therefore; there are no responsive records to answer request #2.
3. Evictions filed by property owners and number of tenants evicted as a result of the ordinance.
* Evictions are filed by property owners and number of tenants evicted as a result of the ordinance are maintained by rental property owners, therefore; there are no responsive records to answer request #3.
4. Suspensions or revocation of a residential rental license, against property owners who fail to comply with the requirements of the ordinance.
* The City does not suspend or perform revocation of a residential rental license against property owners who fail to comply with the requirements of the ordinance.
5. Police calls, reports, citations, or arrests, collected by the municipality police department for the purpose of enforcing the ordinance.
* These records are protected as confidential criminal investigations and/or intelligence information. Pursuant to N.C.G.S. §132-1.4(a), records of criminal investigations conducted by public law enforcement agencies are not public records as defined by N.C.G.S. 132-1. Due to the foregoing, the CMPD cannot release the requested information. Records of criminal investigations conducted by public law enforcement agencies may be released by order of a court of competent jurisdiction. Pursuant N.C.G.S. §132-1.4(b) (2), "Records of criminal intelligence information" means records or information that pertain to a person or group of persons that is compiled by a public law enforcement agency in an effort to anticipate, prevent, or monitor possible violations of the law. Records of criminal intelligence information conducted by public law enforcement agencies may be released by order of a court of competent jurisdiction.
6. Meeting minutes and correspondence between municipality officials, regarding the implementation and enforcement of the ordinance

I was wondering if you would be able to let me know if this https://www.charlottenc.gov/files/assets/police/v/1/documents/supportdocs/remedialactionplan2010.pdf is the current version of the remedial action plan that the "Residential Rental Registration and Remedial Action Program" as described in Sec. 6-580-Sec. 6-590 is referring to.
