Pursuant to North Carolina Public Records Law (G.S. §§ 132-1 through 132-10), I hereby request the following documents:
Documents concerning IMSI catchers or any of the following words: "Stingray", "cell site simulator", or "dirtbox". including:
-Contracts with the Harris Corporation regarding the acquisition of their Stingray or KingFish IMSI catchers
-Department policies and procedure regarding the use of IMSI catcher technology
-policies and procedures on the keeping of statistics about the Department's use and acquisition of IMSI catchers
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Purchase Orders attached are redacted in accordance with the FBI’s review of the information and their requirements under federal law for privileged information.
The use of the equipment by CMPD is in accordance with state and federal law and the applicable standards of probable cause as set out in a court order or search warrant prior to using the equipment.

Regarding the latter part of your correspondence, is the lack of policy and procedure in your response an indication that the Department does not have official internal policies concerning cell site simulators? Or are you exempting them? Thank you for your time and hard work on my request.

All of the CMPD policies and SOP’s are on line on the public CMPD website- we follow the statutory requirements under federal and state law for this equipment.

Thank you. I just checked it out and all I could find that might be relevant to cell site simulators was the search warrant procedure. Does CMPD follow the standard search warrant policies when using IMSI catcher technology? I just want to make sure I am understanding correctly. Thank you very much for your time and the work you do.
