Pursuant to North Carolina Public Records Law (G.S. ยงยง 132-1 through 132-10), I hereby request the following documents:

Records of communication (letters, memoranda, e-mail messages, etc.) with United States Federal Bureau of Investigation ("FBI") regarding 1) non-disclosure agreements between your agency and FBI or 2) non-disclosure agreements between your agency and Harris Corporation. This should include but not be limited those communications to which Senior Assistant City Attorney Judith Emken referred in her e-mail to me of October 29, 2014, in which she denied my request for access to public records and wrote that "per the FBI," nondisclosure agreements with the Harris Corporation or with the FBI "are not able to be released."

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

I received your e-mail of December 12. Neither it nor the e-mail message you attached contains the records I requested on November 11, an estimate of when the records will be provided, or specific exemptions to North Caroline Public Records law which would render the records unreleasable.

As a reminder, I requested: Records of communication (letters, memoranda, e-mail messages, etc.) with United States Federal Bureau of Investigation ("FBI") regarding 1) non-disclosure agreements between your agency and FBI or 2) non-disclosure agreements between your agency and Harris Corporation. This should include but not be limited those communications to which Senior Assistant City Attorney Judith Emken referred in her e-mail to me of October 29, 2014, in which she denied my request for access to public records and wrote that "per the FBI," nondisclosure agreements with the Harris Corporation or with the FBI "are not able to be released."

To be clear: On November 4, I requested not NDAs themselves, but communication with FBI regarding any such NDAs. One example I gave was the communication from FBI to which Ms. Emken referred in her October 29 e-mail.

Please provide the records I requested.
