Pursuant to the South Carolina Public Records Law, I hereby request the following records:

With respect to the Facebook page located at http://www.facebook.com/CityCharleston and the Twitter account https://twitter.com/CityCharleston, I request the below records.

An example of what each of these records look like is attached and available at https://www.documentcloud.org/documents/21579793-facebook-and-twitter-settings-examples. I request:

1. A copy of the full settings for the Facebook page, including records relating to the "Page Visibility," "Country Restrictions," "Age Restrictions," "Content Moderation," and "Profanity filter" settings, including any words or symbols associated with the "Content Moderation" filter. (For an example of this, see the first page of the examples at the above URL.) These records may be accessed through one of three processes:
The first option:
(a) Log in as an administrator of the page.
(b) Navigate to the Facebook page (e.g., https://www.facebook.com/CityCharleston).
(c) On the lefthand side of the page, where it says "Manage Page," scroll to "Settings," located at the lefthand side of the bottom of the page.
(d) Click "General" on the lefthand side of the page.

The second option:
(a) Log in as an administrator of the page.
(b) Go to the following URL: https://www.facebook.com/CityCharleston/settings/?tab=settings.

The third option:
(a) Log in as an administrator of the page.
(b) Navigate to the Facebook page (e.g., https://www.facebook.com/CityCharleston).
(c) Go to this URL: https://www.facebook.com/CityCharleston/settings/?tab=settings&ref=page_edit&section=download_your_page
(d) Click "Download your page"
(e) Select "HTML," "High," and "All time" in the available options.
(f) Make sure only the "Page profile information" and "Page settings" boxes are checked.
(g) Click "Request a download."
(h) When the information is ready to download, enter the password to download it.
(i) Press "confirm."
(j) Provide the files contained in the .zip file.

2. A copy of the list of banned people and pages. This record may be accessed in this manner:
(a) Log in as an administrator of the page.
(b) Navigate to the Facebook page (e.g., https://www.facebook.com/CityCharleston).
(c) On the lefthand side of the page, where it says "Manage Page," scroll to "Settings," located at the lefthand side of the bottom of the page.
(d) Click "People and other Pages" on the lefthand side of the page.
(e) On the menu labeled "People who Like this Page," select "Banned People and Pages"

3. A copy of the list of "Page Roles." This record may be accessed in this manner:
(a) Log in as an administrator of the page.
(b) Navigate to the Facebook page (e.g., https://www.facebook.com/CityCharleston).
(c) On the lefthand side of the page, where it says "Manage Page," scroll to "Settings," located at the lefthand side of the bottom of the page.
(d) Click "Page Roles" on the lefthand side of the page.

4. A copy of the lists of users blocked by the Twitter account. This list can be obtained through this process:
(a) Log into the account.
(b) Visit this URL: https://twitter.com/settings/blocked/all
(c) Visit this URL: https://twitter.com/settings/blocked/imported

5. Any policy concerning public use of or interaction with the Facebook and Twitter accounts.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Thank you for submitting a records request to the City of Charleston, South Carolina to be processed under the South Carolina Freedom of Information Act (FOIA). Your request was received on May 10, 2022, and is being processed in accordance with S.C. Code Ann. § 30-4-10, et seq. Your request has been assigned the reference number F001984-051022 for tracking purposes.

The City of Charleston will provide a formal acknowledgment within 10 business days informing you of the availability of the non-exempt “public records” that you have requested and providing a time and cost estimate to make those public records available to you. For records more than 24 months old, the City has 20 business days to respond on availability and cost. We do not guarantee that a records search will result in any responsive records being located.
Fulfillment of FOIA requests is subject to fees for search, retrieval and redaction, as well as fees for providing copies of documents. A deposit of twenty-five (25%) percent of the total reasonably anticipated cost for fulfilling the request may be required prior to searching for or making copies of records. The full amount of the total cost must be paid at the time of the production of the request.
If the request is granted, the records will be furnished or made available for inspection or copying no later than thirty (30) calendar days from the date on which the formal acknowledgement was provided, unless the records are more than two (2) years old, in which case they will be made available no later than thirty-five (35) calendar days from the date on which the formal acknowledgement was provided. If a deposit is required, the records will be furnished or made available for inspection or copying no later than thirty (30) calendar days from the date on which the deposit is received, unless the records are more than two (2) years old, in which case they will be made available no later than thirty-five (35) calendar days from the date on which the deposit was received to fulfill the request. The City may impose reasonable rules concerning time and place of access to records.
* Please note that pursuant to S.C. Code Ann. §30-2-50, obtaining or using public records for commercial solicitation directed to any person in this State is prohibited. A person who knowingly violates this section is guilty of a misdemeanor and, upon conviction, must be fined an amount not to exceed five hundred dollars or imprisoned for a term not to exceed one year, or both.
We do not make public, and will not produce in response to your request, those records that are exempt from disclosure under S.C. Code Ann. § 30-4-40 or other state and federal laws.

Dear Adam Steinbaugh,

The City of Charleston and the City of Charleston Police Department received four requests, two on May 3, one on May 9, and one on May 10, from you. Each one requested the same information regarding facebook setting information. Please accept the below as both the City of Charleston and the Charleston Police Department’s response to all of the above referenced requests.
After review, we are unable to provide any documents responsive to your request. South Carolina Code Section 30-4-20(c) defines a “public record” as “all books, papers, maps, photographs, cards, tapes, recordings, or other documentary materials regardless of physical form or characteristics prepared, owned, used, in the possession of, or retained by a public body.” South Carolina Code Section 30-4-30(A)(2) states that, “A public body is not required to create an electronic version of a public record when one does not exist to fulfill a records request.” Because your request is not for information that would be considered documentary materials and the City is not required to create an electronic version of a public document when one does not exist to fulfill a request, the City and CPD do not have any documents responsive to your request.
Please do not hesitate to contact us if you believe you received this message in error or there were any omissions. This now completes the City’s response to your FOIA request and this matter is now considered closed.
