Pursuant to the state Freedom of Information Act, G.L.M. c.66, §10, I hereby request the following records:

Any records related to Aaron Swartz or the downloading of JSTOR articles via MIT from 2009 to 2014 within your agency's possession.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

It is noted that a Cambridge Police Detective was involved at some point into the investigation of Aaron Swartz, therefore, to my knowledge, some record(s) must exist within Cambridge Police Department and not just MIT Police Department.

Per our previous response, the Cambridge Police Department’s records on this matter have been provided. The charges against Aaron Swartz were brought by Federal Prosecutors, not by the City of Cambridge.

Hi Seah,

My request was fulfilled, yet this is the second time Cambridge PD has told me there are no records regarding him. I understand that Cambridge PD played only a minor role in the whole case overall, but the records do indeed exist and the City of Cambridge thankfully provided them (and I respect them for that). The two documents do indeed display Cambridge Police Department. So, I'm not sure what the discrepancy is, but please do not perceive this as a challenge, as it is not meant to be interpreted that way. Either way, I thank you.

No response is needed here, I just attaching these files so that it is publicly viewable. It does indeed display "Cambridge Police Department" at the top of these documents, provided by the City of Cambridge. The CAD report notes that MIT police requested a CPD unit (as backup, I presume) on 01/06/2011.
