Pursuant to the Maryland Public Information Act, I hereby request the following records:

1. All information reported to the Maryland Police Standards and Training Commission regarding Serious Police Officer Involved Incidents and Officers Disciplined as required by Public Safety Article §3-207(b)(1) in 2017 and 2018.
2. All traffic stop data reported pursuant to Maryland Transportation Article, § 25-113 for stops made in 2017 and 2018.
3. The total number of civilian complaints reported in 2016, 2017, and 2018 (separated by year).
4. The total number of civilian complaints sustained in 2016, 2017, and 2018 (separated by year).
5. The total number of uses of force reported in 2016, 2017, and 2018, separated by type of force used for each year (separated by year).

Note, I’m requesting aggregate statistics or these requests, which does not include identifiable or protected information regarding complaints, officer personnel records, or use of force.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear. Mr. Sinyangwe,

The Calvert County Sheriff's Office is in receipt of your email below dated November 25, 2019, wherein you make a request pursuant to the Maryland Public Information Act. Specifically, you request: (1) All information reported to the Maryland Police Standards and Training Commission regarding Serious Police Officer Involved Incidents and Officers Disciplined as required by Public Safety Article §3-207(b)(1) in 2017 and 2018; (2) All traffic stop data reported pursuant to Maryland Transportation Article, § 25-113 for stops made in 2017 and 2018; (3) The total number of civilian complaints reported in 2016, 2017, and 2018 (separated by year); (4) The total number of civilian complaints sustained in 2016, 2017, and 2018 (separated by year); and (5) The total number of uses of force reported in 2016, 2017, and 2018, separated by type of force used for each year (separated by year).

For the first category of records, I am denying your request in part under GP § 4-311 because part of the request seeks confidential personnel records. Any records that are personnel records will either be withheld or redacted to protect the privacy of the employee involved. Reports made to the Maryland Police Standards and Training Commission will be produced, although there may be redactions.

For the remaining categories of records, under the MPIA the Sheriff is only required to provide the "public records" in its custody and control as defined in GP § 4-101(j). It is not obligated to create or compile a new public record to provide information sought in the requests. See GP § 4-205(c). Although the Sheriff is not obligated to generate records, it is within the agency's existing functionality and in the normal course to keep certain information you request in databases and some of information can readily be produced. To the extent the agency's existing functionality allows for readily producing this information, the Sheriff's office will provide responsive information. Existing records of reports made to the Maryland Statistical Analysis Center pursuant to Maryland Transportation Article, § 25-113(e)(1), as described in category 2, will be produced.

Pursuant to GP § 4-362, you are entitled to seek judicial review of this decision. You also have the option to refer any concerns about this decision to the Public Access Ombudsman pursuant to GP § 4-1B-01 et seq. If you have any questions about this letter, please feel free to contact me.

Pursuant to GP § 4-361, you are entitled to an administrative review of a decision to deny access. If requested, such review will be conducted in accordance with GP 4-361(b). You may also seek judicial review under GP § 4-362.

Thanks for sending this. I requested data showing the number of incidents involving each type of force being used. For example, the number of times a taser was used, the number of times a baton was used, etc for each year separately. Please send this data as soon as possible.
