Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

Public disclosure legal log (log of public records requests received by your agency, along with classification, time dedicated to processing each request, current status, final resolution, etc.)

If this record exists in electronic form, I request that you not create a new record for me (e.g., by printing your electronic record then scanning it to make a series of images of the printed data) but provide the electronic record itself in its native format.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Hello Mr. Mocek,

The Bellevue Police Department does not have a "Public disclosure Legal Log".

What we do have is a "Dissemination Log" that goes back 7 years (i.e. we have 07/01/08 to 07/14/14 as of today; the system self purges daily.)
Our log will tell you: Date sent, Case #, Type of Case, Company and/or individual asking for case copy, how we sent it, who sent it and system date of when sent.

Do you want a copy of this? If so what date range do you want?

We would have to mail this to you and we charge $5 per CD of information.

Once we hear back from you we can better estimate a completion date for this request.

I used the terminology Seattle Police Department staff use. I seek your log of all public records requests, not limited to those related to a case. At a minimum, I hope to find what has been requested, by whom, when it was requested, when you completed the request, and how you completed it.

Why did you write that you would need to mail it? I would prefer to receive it via attachment to email. Reminder: I request this electronic record in its native electronic format. I do not wish for you to create a new record, for instance, by printing your record, then scanning it and providing the series of images of the printout.

Hello Mr. Mocek,

Attached please find a "read only" copy of our dissemination log. This is what the Bellevue PD uses to keep track of what we have sent out for Public Disclosure Requests.

When you open this file you should see this screen:

Push the “read only” button and it will take you to the copy of the log.

Your request has been filled and closed out as of todays date. As previously stated this log only goes back about 5 years as the system self purges daily.

This record appears incomplete. For example, I have placed multiple requests for public records with your department in the past couple years, but I find none of them in the spreadsheet you provided. Please advise.

Hello Mr. Mocek,

Until sending you a copy of the Dissemination log all requests you have made previously have gone through our City Clerks-City Public Records Office or the Police Administrators/Legal Office due to what you were asking for. These are separate logs and separate offices from Police Records. I have advised the Police Administration/Legal Office to send a log to you if they have one. If you would like to make a request for the log from City Records, please email: PublicRecords@bellevuewa.gov and they will put a request in for you to get a copy of their log.

You did not see an entry on the Police log I sent you of your request because we do not log anything until after a request is completed. Also, for Police Records if we have no records to send we do not log the request, as nothing was sent. We have a separate file we keep for two years as retention laws dictate on all communications regarding Disclosure requests. If a request comes in where we have no records it gets put in this file as we have no electronic file to log these communications.

The BPD Records section informed me of your request for a dissemination log of public disclosure requests. Attached is a log I keep for my personal use. As the legal advisor for the department, I handle the public disclosure requests related to (1) internal investigations; (2) litigation matters; (3) broad requests made to BPD Records/City Clerk's Office for assistance; and (4) administrative documents. I started my employment on April 1, 2014, so my log is only for 2014.
