Your responses to this Public Records request are confusing and inadequate.

Part 1 of my request was as follows:

1. Any and all emails, texts, papers and records referencing complaints, c, and/or communications of any kind regarding assault, battery, or use of force against students, staff, or persons, at Newport High School, 4333 Factoria Blvd SE, Bellevue, WA 98006.

You write, "As I reported on January 28, 2022, with respect to item 1, no records are known to exist at this time."

The records either exist or they do not. Under the Washington State Public Records Act I request, you search, redact where appropriate, and then produce the record. Your statement leads me to believe you did not conduct and adequate search for the responsive records requested in part 1. If so, where did you search for records in part one of the request? Please state the locations searched and then state no records for part one of the request exist. Thank you.

Part 2 of my request was as follows:

I understand the District is declining to produce records based on an exemption or exemption(s). However which specific exemption is being exercised for which specific record? Nothing has been produced. If the District withholds a record in its entirety, the District is required to define with specific clarity what record is being withheld and why. Again, each record being withheld, where the record was located, the nature of the record, the type of record, the page count, length, or size of the record, a description of the record, and the specific reason the record is being withheld in its entirety and not just redacted and then produced under the Public Records Act.

Part 3 of my request was as follows:

3. Any and all emails, texts, papers and records referencing Lockdowns at Newport High School, 4333 Factoria Blvd SE, Bellevue, WA 98006.

You produced 7 pages of emails. Upon information and belief hundreds if not thousands of pages of responsive pages are being silently withheld by the District on this requested topic regarding the Lockdowns and allegations of assault that took place at Newport High School in Bellevue Washington.

Please explain.

Thank you for your questions below. I would be glad to supplement the District’s response to your closed request, if appropriate, to make sure you receive what you expected to receive, consistent with the Public Records Act.

Initially, please note that the date of your request determines the dates of potentially responsive records. Only records that existed as of November 22, 2021 are potentially responsive.

Also, the request stated that the “time period for all records being requested is January 1, 2020 - November 22, 2021.” Based on that date range, the November 22, 2021 date of your request, and the specific references in parts 2 and 3 to “Student Protests” and “Lockdowns,” I interpreted all three Parts of your request to apply to the events of November 19, 2021 at Newport High School.
Part 1
Based on the interpretation above, upon inquiries to staff with direct knowledge and upon the review of records regarding the events of November 19, 2021, I was not made aware of any “complaints, allegations, and/or communications of any kind regarding assault, battery, or use of force against students, staff, or persons, at Newport High School.”
The phrasing of the response that “no records are known to exist at this time,” simply takes into account the possibility, which is sometimes more remote than at other times, that records may be later-discovered.

Clarification Questions re Part 1:

1. Please clarify whether the interpretation of Part 1 of your request, as described above, above was inadvertently too narrow. If you were seeking records regarding any and all such “complaints, allegations and/or communications of any kind regarding assault . . . at Newport High School” on any date between January 1, 2020 and November 22, 2021, whether or not those complaints or allegations related to the events that occurred on November 19, 2021, I will renew my inquiries and searches.
2. If the interpretation of Part 1 of your request was correct, that it applied to the events of November 19, 2021 at Newport High School, please advise on what basis you have reason to believe that any such records exist. If you have documentation or information that suggests such records exist, please describe, provide a copy of, or otherwise specify that documentation or information. It is a requestor’s obligation to specify the request in such a way that makes it possible for the District to perform searches for reasonably locatable records. It is not the agency’s obligation to guess what a requestor is seeking. For example, you may have seen or heard of a report about the events of November 19, 2021 that was factually inaccurate, which could be addressed if you provide specifics of the basis upon you are relying.

Parts 2 and 3
Again, the problem may be that I interpreted your request, based on the timing of the request, and the use of the terms “Student Protests” and “Lockdowns” to apply to the events of November 19, 2021 at Newport High School.

As stated in my April 22, 2022 email, the District’s response that records would be fully withheld based on student privacy and confidentiality under the Public Records Act and FERPA was made “[w]ith respect to items 2 and 3.” The records withheld include such items as Notices of Disciplinary Action, hearing notices, HIB and other investigatory records, and email and/or letter communications between school staff and a number of students and families. The Public Records Act and FERPA apply to exempt all of those highly confidential student records from disclosure. (Please note that the District withdraws the potential exemption based on code 4L.)
Generally, a requestor with no relationship to any involved student understands and accepts such an explanation about the fundamental importance of student privacy, without the need for the District to create a detailed exemption log. However, the District can prepare such a log if you find it to be necessary. The specific reasons for the records being withheld, in all cases, are based on the explanations set forth in the attached Redaction and Exemption Codes chart for codes 1A and 10A (subsection 1), describing exemptions that protect the privacy and confidentiality of information related to students. Other exemptions may also apply to some records. However, the fundamental and primary bases applicable to all withheld records are the confidentiality and privacy of student information of those records and contained in those records, upon which they are exempt and must be fully withheld, for the reasons set forth above and as explained to you on January 28, 2022 and April 22, 2022. Please advise whether you understand and accept these explanations, which apply to all withheld records, as satisfactory for your purposes. If not, a detailed exemption log will be prepared.

Clarification Questions re Parts 2 and 3:

1. Please clarify whether the interpretation of Parts 2 and 3 of your request, as described above, was inadvertently too narrow. If you were seeking records regarding any “Student Protest,” or any “Lockdown” between January 1, 2020 and November 22, 2021, whether or not the Student Protest or Lockdown related to the events that occurred on November 19, 2021 at Newport High School, I will renew my inquiries and searches.

If your intent was to seek records related to incidents other than the events of November 19, 2021 at Newport High School, please define “Student Protest” and “Lockdown.” For example, do you want records regarding both building-level lockdown drills and actual lockdowns? What, in your view, comprises a “Student Protest”? Would that include, for example, a student’s inquiry about a grade or a class assignment?

1. If the District’s interpretation of Parts 2 and 3 of your request was correct, please advise on what basis you have “information and belief” to have the formed the opinion that “hundreds if not thousands of responsive pages are being silently withheld.” The District is not withholding any records and has no reason or motivation to do so. If you have documentation or information that suggests such records exist, please describe, provide a copy of, or otherwise specify that documentation or information. It is a requestor’s obligation to specify the request in such a way that makes it possible for the District to perform searches for reasonably locatable records. It is not the agency’s obligation to guess what a requestor is seeking. For example, you may have seen or heard of a report about the events of November 19, 2021 that was factually inaccurate, which could be addressed if you provide specifics of the “information and belief” upon which you are relying.

General Clarification Question:

1. In your comments about the District’s response to Part 3 of your request, you state, “Upon information and belief hundreds if not thousands of pages of responsive pages are being silently withheld by the District on this requested topic regarding the . . . allegations of assault that took place at Newport High School in Bellevue Washington.” The bolded part of that sentence as quoted appears to refer to Part 1, not Part 3, of you request. Again, the District is not withholding any records and has no reason or motivation to do so. If you have documents supporting your “information and belief” that such records exist, please describe, provide a copy of, or otherwise specify that documentation or information. It is a requestor’s obligation to specify the request in such a way that makes it possible for the District to perform searches for reasonably locatable records. It is not the agency’s obligation to guess what a requestor is seeking. For example, you may have seen or heard of a report about the events of November 19, 2021 that was factually inaccurate, which could be addressed if you provide specifics of the “information and belief” upon which you are relying.

Your answers to these clarification questions are due in 30 days, i.e., on or before June 23, 2022. If your answers provide a basis upon which the District could supplement its April 22, 2022 response, I would be glad to do so.

Please note that two records are being withheld in their entirety. Both are excel attachments to emails, one sent on 8/24/2021 and the other on 8/27/2021. Both of attachments contain only student identifying information and are therefore exempt from production under RCW 42.56.230(1).
