Pursuant to the Arkansas Freedom of Information Act, I hereby request the following records:

All materials on or related to Gender X driver's licenses and state IDs. This includes, but is not limited to, the following records:

•Emails containing the keywords "Gender X," "transgender," "intersex," "Two-Spirit," "gender identity," and "sexual identification" from the first issuance date of Gender X driver's licenses and state IDs
•Marketing materials such as brochures, pamphlets, cards, etc.
•Any policy directives, guidance documents, memorandum, training materials, or similar records
•Revenue made off of Gender X driver's licenses and state IDs, and/or the total number of people with Gender X driver's licenses and state IDs

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In response to your FOIA request, attached please find the policy memo that was distributed to all Revenue Office agents in December 2010 (the gentleman that established/sent this memo is no longer
with DFA). Since retention policies do not require email be maintained going back roughly nine years, I have not been able to find the email that accompanied this memo (the memo was maintained by Revenue Offices). It is my understanding from speaking to those here at the time that the attached memo was simply emailed to Revenue Offices without any additional commentary as we did with all policy memos.

Since this policy was established in December 2010, DFA has issued a total of 288 licenses/IDs that list “Other” or “X” as gender.

While we don’t’ have a specific revenue total to associate with the 288 licenses, if each person paid the $40 to obtain a license (there are discounts for those over a certain age, etc), that would be roughly $11,520.

DFA did not create any brochures, pamphlets, cards, etc. promoting this policy.

The only directive was the attached policy memo.
