Pursuant to the Idaho Public Records Act, I hereby request the following records:

Copies of emails sent to, from, or through the High Tech Crime Consortium ListServ. The emails may be identified by having one or more of the following:

* A sender with a display name of either "High Tech Crime Consortium Listserv" or "High Tech Crime Consortium"
* A subject containing either "HTCC" or "[HTCC]"
* Sent to or from an email address containing "htcc" or hightechcrimecops.org

You may limit this request to records generated between April 1, 1998 and the date of the processing of this request.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have received your records request. After conducting a search of our email server in regards to communication between the High Tech Crime Consortium Listserv (a.k.a “HTCC) and Ada County Sheriff’s Office employees, enclosed are the records we were able to determine meet the specific criteria in your request. We were able to search from April 1, 1998 to August 10, 2020. To protect the privacy of citizen information who are not Ada County Sheriff employees and to protect against the release of any investigative techniques these records have been redacted pursuant to Idaho Code 74-124(c) and (e).

This response has been reviewed by our legal counsel. This response provides records held by the Ada County Sheriff and does not contain information held by other Ada County officials nor any other law enforcement agency. All record responses may be appealed by filing a petition in conformance with the provisions of the Idaho Code Title 74, Chapter 1. Your petition must be filed in the Fourth Judicial District Court of Idaho within one hundred and eighty (180) calendar days of the mailing of this notice. Any release of public records is not permission to allow you to republish or otherwise make use of the records in violation of state or federal trademark and/or copyright law. Thank you for your response! I do have a question, however. I can file an appeal or a separate request, but thought it might be easier for all involved to reach out and inquire about the email attachments. Were they all withheld? Is it possible to have them included in the request, or should I file a separate request? I suspect the latter might create unnecessary work for your office, though I understand that procedure is procedure and bureaucracy is bureaucracy.

Thank you again for your quick response and production of the emails. The speed and quality of your response is better than many of your peers. =)
