What Happens After A FOIA Appeal Filing Date is Missed ?
Can the FOIA requester file another request in the future with slightly different wording than the original request ?
I have missed several appeal deadlines (because of other commitments) and would like to know if there is a possible work around to get the information I originally requested.
When I’ve missed appeal deadlines, I’ve re-filed the same request. Then they reject it again, and I appeal. As far as I know, there’s no solid ground for an agency to refuse to process the same request again.
Other than that, there’s nothing that can be done once an appeal deadline is missed. At that point, that particular request is finito.
