Pursuant to the Wyoming Public Records Act, I hereby request the following records:

The following materials regarding the imposition, assessment, collection and balances of inmate fees and debt:

a) All current policies and procedures regarding medical and room & board costs or fees for which inmates are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).

b) All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of individuals charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Hi Mercy,

The Wyoming Department of Corrections (WDOC) does not charge any fees, co-pays, room or board for any inmates related to medical. It is fully covered by the WDOC. If an inmate releases to a half-way house in the community they are responsible for there own medical costs while not in a secure facility. We have three half-way houses in Wyoming but they are all run by private companies. In short, I do not have any records that would be relevant to your request. Please let us know if you have any questions.

Hi,

Thanks so much for your help with this request! I really appreciate it.

May you confirm whether or not the Wyoming Department of Corrections collects and/or imposes room and board or medical fees for incarcerated adults? I have found statutory evidence that suggests the department is authorized to collect fees. Below for your reference are statutes:

"Wyo. Stat. Ann. § 7-13-109
In addition to any other punishment prescribed by law, the sentencing court may require a person sentenced to confinement in county jail, for any offense, to pay the jail facility the costs of room and board for each day of incarceration, both before and after conviction. The costs for room and board for each day of incarceration shall be an amount equal to the actual cost of the services as determined by the county sheriff. The cost of the services shall be paid to all jail facilities where the inmate may have been held before and after conviction."

"Wyo. Stat. Ann. § 7-16-205e - Disposition of earnings; confidentiality of amount
“The department of corrections may establish regulations providing for assessment of fees to prisoners for self-improvement programs, services, including medical services, and assistance provided by the department when the inmate has money to pay for the programs, services and assistance.”"
