Pursuant to the New York Freedom of Information Law, I hereby request the following records:

From the time period of January 1, 2020 to the present, any algorithms, risk assessments, flowcharts, manuals, slideshow presentations, guides, charts, graphs, or items that determine whether someone is eligible to be tested for COVID-19 (aka Coronavirus).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Hello Mr. Lecher,

Pursuant to Section 89(3) of the Public Officer's Law, commonly known as the Freedom of Information Law (FOIL), this will constitute a written acknowledgement of your email received Monday, December 28, 2020. Furthermore, this shall be a written statement of the approximate date when the request will be granted or denied, which I estimate to be by Monday, January 25, 2021.

Hello Mr. Lecher,

This shall be the Office of the Westchester County Executive’s formal response to your Freedom of Information Law (FOIL) request dated Monday, Monday, December 28, 2021​. The FOIL is intended to allow citizens to have access to records made and kept by a public body.

You asked for records regarding:

“...any algorithms, risk assessments, flowcharts, manuals, slideshow presentations, guides, charts, graphs, or items that determine whether someone is eligible to be tested for COVID-19 (aka Coronavirus)."

I certify that after a diligent search of the Westchester County Executive's Office we have records responsive to your request which are in the possession of our office and required to be disclosed​ under FOIL. For your convenience, I have attached the record to this email free of charge.​

Our office did not receive your initial FOIL request. We have responded with a timeframe of January 1, 2020 to March 20, 2020, assuming the parameters of your earliest request. If you would like records from January 1, 2020 to December 2020 or beyond please indicate so. I can advise you that providing records through this period - or beyond - will be a lengthy process, and will require additional time to fulfil.
