Under the West Virginia Freedom of Information Act, ยง29-B-1-1 et seq., I am requesting an opportunity to inspect or obtain copies of public records that:

- Active contracts with third-party vendors exceeding $50,000 for medical services that are provided to individuals in the custody of the West Virginia Division of Corrections and Rehabilitation (WVDOCR)
- Proposed contracts with third-party vendors exceeding $50,000 for medical services that are provided to individuals in the custody of the WVDOCR
- The enacted WVDOCR budget for fiscal year 2021
- A list of all medical institutions external to the FDOC which provide inpatient and outpatient services to the individuals in WVDOCR custody


The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filed electronically, by e-mail attachment if available or CD-ROM if not. However, we respectfully request a waiver of these fees as we are affiliated with an educational or noncommercial scientific institution, and this request is made for a scholarly or scientific purpose and not for a commercial use.

The West Virginia Freedom of Information Act requires a response to this request be made within five business days. If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.

Should you deny my request, or any part of the request, please state in writing the basis for the denial, including the exact statutory citation authorizing the denial as required by s. 119.07(1)(d), F.S. Also, please provide all segregable portions of otherwise exempt material.

Dear Mr. Behne,

This is a response to your request, received by the Legislative Manager of the West Virginia Legislature on January 10, 2022, made pursuant to the West Virginia Freedom of Information Act. In your request, you asked for several records relating to the budget, contracts, and medical provider information for medical services rendered for inmates of the West Virginia Division of Corrections and Rehabilitation.

The West Virginia Legislature is not the custodian of public records regarding medical providers and contracts for inmate medical services for the Division of Corrections and Rehabilitation. To obtain those records, you would have to submit your request directly to that division.

Of the records that you have described, the only record that is in the custody of the Legislature is the enacted Budget Bill for the 2020-2021 state fiscal year. I have enclosed a copy of this document pursuant to your request.

This completes my response to your request under the provisions of the West Virginia Freedom of Information Act. If you believe that you have been improperly denied records that you have requested, you may seek injunctive or declaratory relief in the Circuit Court of Kanawha County.
