I am requesting all records and documents related to the Wilson Aquatic Center in Washington, D.C. between thee dates of Oct. 1, 2022 and the date of this request, Feb. 11, 2024. This request covers, but is not limited to, emails, contracts, work orders and any other documents and records related to the maintenance, operation, repair, and closure of the center.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to the FOIA request for the following:

Pursuant to the DC Freedom of Information Act, I hereby request the following records:

I am requesting all records and documents related to the Wilson Aquatic Center in Washington, D.C., between the dates of Oct. 1, 2022, and the date of this request, Feb. 11, 2024. This request covers, but is not limited to, emails, contracts, work orders, and any other documents and records related to the maintenance, operation, repair, and closure of the center.

DGS determined during the intake process that the request for "all records, documents, and any other documents" was too broad of request. However, we identified that you are seeking emails, contracts, and work orders related to the maintenance, operation, repair, and closure of the Wilson Aquatic Center between the dates of October 1, 2022, and February 11, 2024.

As it relates to the request for emails, the FOIA process requires DGS employee names to generate the mailbox report and search terms to assist with the generated report.

We have inquired about the appropriate component of DGS for responsive records identified. If any such record exists, our office will provide it.
To allow staff to search for emails, please submit the DGS employee's names and search terms. If we do not receive the additional information, this will result in the closure of the email request.

As provided by FOIA, a response to your request for records identified will be made available no later than 15 working days from receipt of your request, which in this case will be no later than March 5, 2024.

Please note that we may extend the time for a response by an additional 10 working days for unusual circumstances, as defined by DC Code 2-532(d).

(d) In unusual circumstances, the time limit prescribed in subsection (c) of this section may be extended by written notice to the person making such a request, setting forth the reasons for the extension and the expected date for determination. Such extension shall not exceed 10 days (except Saturdays, Sundays, and legal public holidays). For purposes of this subsection, and only to the extent necessary for processing the particular request, "unusual circumstances" are limited to:

(1) The need to search for, collect, and appropriately examine a voluminous amount of separate and distinct records that are demanded in a single request; or

(2) The need for consultation, which shall be conducted with all practicable speed, with another public body having a substantial interest in the determination of the request or among two or more components of a public body having substantial subject-matter interest therein.

You will be notified if such an extension is applicable in this instance.

This is regarding the FOIA request for following:

I am requesting all records and documents related to the Wilson Aquatic Center in Washington, D.C., between the dates of Oct. 1, 2022, and the date of this request, Feb. 11, 2024. This request covers, but is not limited to, emails, contracts, work orders, and any other documents and records related to the maintenance, operation, repair, and closure of the center.

DGS notified you on February 12, 2024, for clarification. We require employee names to generate the mailbox report and search terms, and contract number. Due to the lack of communication this will result in closure of the request for emails and contract records.

We are searching our records for the following:

* Work orders related to the maintenance, operation, repair, and closure of the Wilson Aquatic Center between the dates of October 1, 2022, and February 11, 2024.

Under the District of Columbia (DC) FOIA the agency has 15 business days and in unusual circumstances can request a 10-business day extension with no additional extensions possible. We are taking a 10-workday extension under FOIA, DC Code §2-531-539 in order to properly process the request for reason due to the need to search for, collect, and examine a voluminous amount of records. Therefore, we will have a response to your request no later than March 19, 2024.

As previously stated, please know that, under D.C. Official Code § 2-537 and 1 DCMR 412, you have the right to appeal this response to the Mayor or to the Superior Court of the District of Columbia. If you elect to appeal to the Mayor, your appeal must be in writing and contain "Freedom of Information Act Appeal" or "FOIA Appeal" in the subject line of the letter as well as on the outside of the envelope. The appeal must include (1) a copy of the original request; (2) a copy of any written denial; (3) a statement of the circumstances, reasons, and/or arguments advanced in support of disclosure; and (4) a daytime telephone number and/or e-mail and/or U.S. Mail address at which you can be reached. The appeal must be mailed to: The Mayor's Correspondence Unit, FOIA Appeal; 1350 Pennsylvania Avenue, N.W., Suite 316, Washington, D.C. 20004. Electronic versions of the same information can instead be e-mailed to the Mayor's Correspondence Unit at foia.mayor@dc.gov.

Further, a copy of all appeal materials must be forwarded to the Freedom of Information Officer of the involved agency or to the agency head of that agency if there is no designated Freedom of Information Officer there. Failure to follow these administrative steps will result in a delay in the processing and commencement of a response to your appeal to the Mayor.
