Pursuant to the DC Freedom of Information Act, I hereby request the following records:

Any policies, rules, or other similar documents outlining the practices of the DGS Protective Services Division regarding the following:

• Hiring & recruitment
• Lateral hires of police or special police officers, including from the MPD or any other agency
• Complaints of misconduct against DGS PSD employees
• Internal investigations into complaints of misconduct
• Disciplinary and appeal of discipline procedures
• Use of force policies, including use of deadly force
• Review of use of force policies

Please also include a copy of the current/most recent collective bargaining agreement(s) with any labor unions or similar bodies representing DGS PSD employees.

We are seeking this information as a news media organization on a matter of public interest concerning the conduct of government. As such, we ask for a waiver of all fees because the information requested can be considered as primarily benefiting the general public D.C. Code Ann. § 2-532(b). If you do deny the fee waiver request, please do not incur fees above $100.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have inquired about the appropriate component of DGS for responsive records. If any such record exists, our office will provide it.

As provided by FOIA, a response to your request will be made available no later than 15 working days from receipt of your request, which in this case will be no later than November 1, 2023.

Please note that we may extend the time for a response by an additional 10 working days for unusual circumstances, as defined by DC Code 2-532(d).

(d) In unusual circumstances, the time limit prescribed in subsection (c) of this section may be extended by written notice to the person making such request setting forth the reasons for the extension and expected date for determination. Such extension shall not exceed 10 days (except Saturdays, Sundays, and legal public holidays). For purposes of this subsection, and only to the extent necessary for processing the particular request, "unusual circumstances" are limited to:

(1) The need to search for, collect, and appropriately examine a voluminous amount of separate and distinct records which are demanded in a single request; or
(2) The need for consultation, which shall be conducted with all practicable speed, with another public body having a substantial interest in the determination of the request or among 2 or more components of a public body having substantial subject-matter interest therein.

DGS’ response as follows:

Under the District of Columbia (DC) FOIA the agency has 15 business days and in unusual circumstances can request a 10-business day extension with no additional extensions possible. We are taking a 10-workday extension under FOIA, DC Code §2-531-539 in order to properly process the request for reason due to the need to search for records. Therefore, we will have a response to your request no later than November 16, 2023.

As previously stated, please know that, under D.C. Official Code § 2-537 and 1 DCMR 412, you have the right to appeal this response to the Mayor or to the Superior Court of the District of Columbia. If you elect to appeal to the Mayor, your appeal must be in writing and contain “Freedom of Information Act Appeal” or “FOIA Appeal” in the subject line of the letter as well on the outside of the envelope. The appeal must include (1) a copy of the original request; (2) a copy of any written denial; (3) a statement of the circumstances, reasons, and/or arguments advanced in support of disclosure; and (4) a daytime telephone number, and e-mail and/or U.S. Mail address at which you can be reached. The appeal must be mailed to: The Mayor’s Correspondence Unit, FOIA Appeal; 1350 Pennsylvania Avenue, N.W., Suite 407, Washington, D.C. 20004. Electronic versions of the same information can instead be e-mailed to The Mayor’s Correspondence Unit at foia.appeals@dc.gov

Further, a copy of all appeal materials must be forwarded to the Freedom of Information Officer of the involved agency or to the agency head of that agency if there is no designated Freedom of Information Officer there. DGS provides the attached for the following:

*Hiring & Recruitment
*Use of force policies, including use of deadly force
*Review of the use of force policies
*Disciplinary and appeal of discipline procedures - DGS Follows the DPM Chapter 16 for Disciplinary and appeal procedures along with the FOP Collective Bargaining Agreement.

We conducted a comprehensive search for records that would be responsive to your request. Unfortunately, we were unable to locate or identify any responsive video for this timeframe for the following:

*Lateral hires of police or special police officers, including from the MPD or any other agency
*Complaints of misconduct against DGS PSD employees
