Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

All requests received by DCJS seeking roster data for all active and/or inactive law enforcement officers in Virginia. Please include the request received by DCJS and any written correspondence between the requester and DCJS, including the final response letter from DCJS. Please search both the official DCJS FOIA inbox as well as the personal work inbox of any DCJS employees who may have responded to such a request. The timeframe for this request is from January 1, 2020 to the present date.

We are seeking this information as a news media organization on a matter of public interest concerning the conduct of government. As such, we ask for a waiver of all fees, if allowed under state law. If fees are necessary to reimburse the agency for actual costs, we agree to pay up to $100. If costs exceed that amount, please let us know before fulfilling the request.

Pursuant to §2.2-3704, a public body may assess a charge to recover costs for searching, accessing, supplying, and duplicating records. The estimated cost to produce the records you requested is $1,417.

In any case where a public body determines in advance that charges for producing the requested records are likely to exceed $200, the public body may, before continuing to process the request, require the requester to agree to payment of a deposit not to exceed the amount of the advance determination. The deposit shall be credited toward the final cost of supplying the requested records. The period within which the public body shall respond under this section shall be tolled for the amount of time that elapses between notice of the advance determination and the response of the requester. A deposit of $709 will be required before any action is taken on this request.

Can you please clarify how you arrived at the assumed hours of work, and the hourly rate of the staff? Please provide an itemized list of costs. You are likely aware that §2.2-3704 provides that "No public body shall impose any extraneous, intermediary, or surplus fees or expenses to recoup the general costs" and that "Any duplicating fee charged by a public body shall not exceed the actual cost of duplication."

As stated in my email to you dated August 2, 2023, pursuant to §2.2-3704, a public body may assess a charge to recover costs for searching, accessing, supplying, and duplicating records. The estimated cost to produce the records you requested is $1,417.

This cost is based on 1 hour per 28 staff members in our Division of Law Enforcement searching for this information on each employee’s email box and reviewing each applicable email at the lowest hourly rate of all 26 employees, @ $28.94 an hour = $810.32. Plus, the hourly rate of two employees not in the Law Enforcement Division, employee #29 (who has to search through multiple email boxes and review multiple emails for applicability to your request) @15 hours x $35.50 and employee #30 for review of all materials prior to sending to you, at 1 hour ($75) = $607. For the combined total of $1,417.

MuckRock has also informed me that there's use of "foia@dcjs.virginia.gov" in requests dating back to January 2022 (see attached). Are you certain that the inbox was not created until October 2022?

Thank you for pointing out this discrepancy. After looking into this further, it appears the FOIA inbox was in place as far back as 2018, accessible only by employees who are no longer employed with this agency. We are working with the Virginia Information Technology Agency (VITA) to determine when the inbox was originally created and to receive access for current employees.

Once access is achieved for me, we will need to search through several more years of emails. The cost for the continued search (going further back than what you were provided on August 8, 2023 which totaled $177.50) is estimated to be 5 hours per each year of searching through the emails. 20 hours X 35.50 = $710. We estimate the total cost for the search of the FOIA inbox going back to 2018, is $710 + 177.50 = 887.50.

Please let me know if you wish to proceed with this search to 2018. Thank you.

1. Our request sought records from 2020-present, not 2018, so please adjust the fee estimate calculations to reflect this. Please provide me with a new estimate prior to proceeding with this narrowed request.

2. The fee estimates you have provided seem quite high on our end. VFOIA has been recently amended to explicitly require that agencies "shall make all reasonable efforts to supply the requested records at the lowest possible cost." § 2.2-3704 (F). The Advisory Council has also stated that "FOIA allows charging for staff time but processing a records request typically is a ministerial task that will be performed by administrative or clerical staff. . . it is presumed that merely attaching an existing electronic document to an electronic mail message and sending it to a requester would incur a negligible expense for the time involved." FOIA Advisory Council Opinion AO-05-19. As we are asking only to be sent previous electronic requests and responses, there shouldn't be a need for much processing or production work here.

Please provide a clear indication of the reasons for why the amount of hours are so high; from our perspective they seem inflated. It seems that your calculations include reviewing every single email in the inbox. Please confirm whether or not this is the case, and if so, we can provide some keywords that would significantly reduce that time estimate.

3. The fees that we had approved of were $100, and we explicitly asked to be notified if the work went over this. The FOIA Advisory Council has stated, "As a matter of interpretation and best practices, a public body should wait until a requester responds to an estimate before proceeding, in order to give the requester an opportunity to agree, to modify the request, or to cancel the request altogether. To do otherwise would render meaningless the language requiring the estimate to be in advance." Advisory Council Opinion AO-05-14. While the Council did express concern that waiting for a requester to approve a modified estimate could cause issues regarding the timing provision contained in a previous version of the statute, the current version of VFOIA explicitly provides that "[t]he period within which the public body shall respond under this section shall be tolled for the amount of time that elapses between notice of the cost estimate and the response of the requester." § 2.2-3704 (F). I had requested an estimate of fees for over $100, and that was not provided to me. Id. ("The public body shall provide the requester with a cost estimate if requested.")

You then replied in your email to me dated August 4, 2023: This is a follow up to a previous request: Hello. For the purposes of this request, I will narrow the accounts to just the DCJS's main FOIA email address.

I took this to be confirmation that you wanted me to continue with your request, which I then completed from the DCJS FOIA email inbox, to October 2022. That cost, as previously stated in my email to you was $177.50 (5 hours @35.50 an hour).

To search the FOIA email inbox back to 2020, (going further back than what you were provided on August 8, 2023) is estimated to be 5 hours per each year of searching through the emails. Thus, 10 hours X 35.50 = $355.

The total cost for the work that was already completed ($177.50) + the continued search to 2020 ($355) will be $532.50. The initial cost of $177.50 will need to be paid as a deposit prior to continuing with this request.

You were correct that I did ask for your to continue with the request in my 8/4 email. But I had no way of knowing what the cost estimate for the narrowed request that I provided was. Nothing else about the language in my initial request changed, including the request to not exceed $100 in fees without notifying us in advance of that work being conducted.

While we believe that DCJS should have stopped work at $100, because that was what was authorized, we will pay the $177.50.
