Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

The application of Seth Walker Layton to participate in VSP's Accelerated Lateral Entry Program. Walker participated in the 133rd Basic Session: https://www.wfxrtv.com/news/local-news/55-members-of-virginia-state-police-133rd-basic-session-receive-their-diplomas/

We are seeking this information as a news media organization on a matter of public interest concerning the conduct of government. As such, we ask for a waiver of all fees, if allowed under state law. If fees are necessary to reimburse the agency for actual costs, we agree to pay up to $100. If costs exceed that amount, please let us know before fulfilling the request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In Hawkins v. South Hill, the Virginia Supreme Court recently found that this exemption can only be used to withhold records "if their disclosure would constitute an 'unwarranted invasion of personal privacy.'" There is no argument from VSP that the release of these records would do so, and already a Circuit Court has found that several previously-withheld records should be released under the new standard (see Hawins v. South Hill decision on remand). This denial is improper and I request that it be reconsidered. This is simple, basic information about the hiring of a public employee, and any properly exempt information can be redacted by VSP.
