Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

Copies of any form DC-91 that were filed in 2018 or 2019

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Nash,

This Office has some but not all of the DC-91 disqualification forms received from general district and juvenile and domestic relations district courts. This Office does not have the DC-91 disqualification forms if the case is one that can be reassigned by the local chief judge because they are not sent to this Office. In addition, any forms we could provide to you would not include forms from juvenile records as they are confidential. Of the forms received from the juvenile and domestic relations district courts, we would only be able to provide copies of the DC-91 from JDR adult criminal cases.

The estimated cost to provide copies of the forms that we possess is estimated to be $1,147.68. This cost included the time for staff to search through the files in which the requested records are maintained, check for any confidentiality issues, copy and reassemble the files. We will require a deposit of the full estimated amount ($1,147.68) before processing your request. Please be aware that if the actual cost of producing the records is less than the estimate, you will be refunded the difference. Likewise, if the actual cost of producing the records is more than the estimate, you will be charged the additional amount. If you wish to move forward with your request, please make your check payable to the Treasurer of Virginia, note invoice #192031-LPR on your check and send it to John B. Rickman, Fiscal Services Director, Supreme Court of Virginia, 100 North 9th Street, 3rd Floor, Richmond, Virginia 23219.

There is no summary of the information contained on the DC-91 – electronic or otherwise. Are you looking for a specific piece of information from the DC-91s?

Among other things, but maybe the most easy to find hopefully, is DC-91 filed for Unlawful Detainer cases in 2019. Thanks!

Mr. Nash,

The DC-91 (attached) does not include a space for case type. Even if you were to move forward with your original request for copies of the forms, you would not be able to know that a particular case was an unlawful detainer.

As I have previously explained, we do not have a list of these forms. In addition, as I explained on 1-13-20, this Office has some but not all of the DC-91 disqualification forms because this Office does not receive the forms if the case is one that can be reassigned by the local chief judge. In addition, some forms may include more than one disqualification. Accordingly, any number we provide would not represent the total number of disqualifications.

In order to determine the number of forms we have, we would need to go through the file cabinets and files and count the forms. The estimated cost to go through the files and count the number of these forms is $286.92. We will require a deposit of the full estimated amount ($286.92) before processing your request. Please be aware that if the actual cost of producing the records is less than the estimate, you will be refunded the difference. Likewise, if the actual cost of producing the records is more than the estimate, you will be charged the additional amount. If you wish to move forward with your request, please make your check payable to the Treasurer of Virginia, note invoice #192036-LPR on your check and send it to John B.
