A copy of the internal review of the January 29, 2017 raid in Yemen and a copy of the investigation on civilian casualties during the raid.

The internal review and the investigation of civilian casualties were mentioned by CENTCOM head Gen. Joseph Votel during his testimony before the Senate Armed Services Committee in March 2017.

This is in response to your Freedom of Information Act (FOIA) request (copy attached) originally submitted to the U.S. Central Command (USCENTCOM) and subsequently referred to U.S. Special Operations Command (USSOCOM). USSOCOM assigned your request USSOCOM FOIA 2018-013.

Records were previously released in response to a FOIA request received before yours. These records are also being provided to you in response to your FOIA request. USSOCOM located 24 responsive documents. Fifteen of the responsive documents are being withheld in their entirety and portions of the remaining nine documents are being partially withheld under 5 U.S.C. § 552, (b)(1), as the information was found to be currently and properly classified in accordance with Executive Order 13526, specifically, Sections 1.4(a), which protects military plans, weapons systems, or operations; 1.4(c), which protects intelligence activities (including covert action), intelligence sources or methods, or cryptology; 1.4(d), which protects foreign relations or foreign activities of the U.S., including confidential sources; and 1.7(e), for compilation of items of information that are individually unclassified by may be classified if the compiled information reveals an additional association or relationship. In addition, portions of the documents are withheld under (b)(2) for Internal Personnel Rules and Practices; (b)(3) 10 U.S.C. § 130b for personally identifying information regarding personnel assigned to an overseas, sensitive or routinely deployable unit; (b)(5), which protects inter and intra-agency records which are both deliberative in nature as well as part of the decision-making process; (b)(6), which protects personal information that if disclosed to a requester would result in a clearly unwarranted invasion of personal privacy; (b)(7)(C), to protect information which could reasonably be expected to constitute an unwarranted invasion of personal privacy; and (b)(7)(F), to protect information which could reasonably be expected to endanger the life or physical safety of an individual. The nine partially withheld documents are being released in redacted format at attachments 2 through 10.

Please inform this office by November 29, 2018 whether the copies of the documents satisfy your FOIA request or if you require a formal response letter with appeal rights. If you are satisfied with the documents provided, we will close your FOIA request with no further action required by this office.
