1. Any and all "referrals and Notifications of Violations of Criminal Conflict of Interest Statutes and other Potential Violations files", pursuant to section 1030.4 of the control schedule, related to VA employees in San Diego and Los Angeles facilities for the past five(5) years.
2. Any and all "Medical Inspector's Investigation Records" and "Medical Inspector's Site Visit Reports", pursuant to sections 1160.1 and 1160.2 of the control schedule, related to VA facilities in San Diego and Los Angeles for the past five(5) years.
3. Any and all "Research Misconduct Case Records Involving Allegations Referred for an Inquiry and/or Investigation", "Research Misconduct Case Records Involving Allegations that are Not Referred for an Inquiry and/or Investigation" and "Case Records Maintained Throughout VHA for Government-wide Suspensions and Debarments Based on Research Impropriety", pursuant to sections 8600.1, 8600.2 and 8600.3 of the control schedule, related to VA facilities in San Diego and Los Angeles for the past five(5) years.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I'd like an update on this request please. I've been trying to get an update for more than a month.

As we discussed on February 12, 2019 via telephone, I am working diligently to complete a partial release response to you despite the fact that I have over 20 requests in front on you in my queue. I also indicated when we discussed that I would do my best to complete this partial response by March 5; however, I do apologize that the response has not yet been issued. By statute, we are required to process our FOIA requests in order of receipt (first in, first out), and I have not yet been able to finalize the response for your request due to the numerous cases ahead of yours. Please trust that I am giving your request the attention that it requires along with the other cases, as I work to process your request as expeditiously as I can with my current caseload.

My new estimated date of completion for your request is April 30, 2019; however, this is only an estimated timeframe as I cannot accurately predict the exact time I will be able to complete your request.

Thank you Amarah. I understand you are working as diligently as possible.

As the FOIA suggests, this is a request that involves a serious potential public health risk involving active research and researchers at two major VA institutions that service hundreds of thousands of veterans.

Because of that and recent developments we've uncovered, I'd like to respectfully cite 5 U.S.C. §552 (E)(v)(I) 5 U.S.C. and §552 (E)(v)(II) and request expedited processing since "a failure to obtain requested records on an expedited basis under this paragraph could reasonably be expected to pose an imminent threat to the life or physical safety of an individual" and "with respect to a request made by a person primarily engaged in disseminating information, urgency to inform the public concerning actual or alleged Federal Government activity."

Please let me know if your office concurs.
