This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of all e-mail discussions of the raid that killed Osama Bin Laden, his burial at sea aboard the USS Carl Vinson, as well as attachments to those discussions, sent from or to crew members or other users of onboard networking and/or e-mail services of the USS Carl Vinson during the month of May 2011.

COMNAVAIRPAC has acknowledged the existence of these records to William T. Kammer, Chief, Freedom of Information Division, Executive Services Directorate, for the Department of Defense, or his personel, in response to an earlier FOIA request, as declared under penalty of perjury in Civil Action No. 1:11-cv-00890-JEB.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is in regards to the FOIA request you submitted to the Chief of Naval
Operations (OPNAV) on 30 JAN 2012, tracking number 2012F02057. OPNAV in
turn referred your request to Commander, Naval Air Forces as your request
concerned the USS Carl Vinson and emails discussions of the raid and burial
at sea..

As you probably are aware, this Office is responding on behalf of the
Department of Defense to all FOIA requests relating to the death of Osama
Bin Laden that were submitted to any component of the Department of Defense.
Your request has been assigned case control number 12 F 0731 in this
Office.

This is also to advise you that we will be unable to respond to your request
within the 20 business days prescribed under the FOIA because there are
unusual circumstances which impact on our ability to quickly process your
request. Specifically, the volume of requests received concerning the death
of Osama bin Laden and the need to coordinate the review of records with
more than one office or organization having a substantial interest in either
the determination or the subject matter of the records.

This response concerns your FOIA request, case number 12-F-0731 (#DON 2012F050574, CNAP #20-12), which asked for email discussions of the raid that killed Osama bin Laden, his burial at sea aboard the USS Vinson sent from or to crew members or other users of onboard networking and/or email services of the USS Carl Vinson during May 2011.

The records you requested are also either fully or partially responsive to several other FOIA requests held by this office. To date, processing has not yet been completed for any of these requests. As one of these requests is now the subject of FOIA litigation, I do not now have an estimated date for completion because the final determination on release will be made in litigation.
