Dear Mr. Green:

By email dated February 12, 2015, this office confirmed receipt of your Freedom of Information Act (FOIA) request. At that time a search of agency records was initiated in all offices for responsive materials.

Due to the extensive search in locating documents, as of February 13, 2015 we will have been unable to process your request within the 20 working day statutory time required by 5 U.S.C. § 552(a)(6)(A)(i)) for informing you of our decision to grant or deny access to the requested documents. I am hereby informing you that an extension of an additional 10 working days is required for completion of your request. Such an extension is allowed by the FOIA in “unusual circumstances”. The FOIA defines “unusual circumstances” as: (1) the need to search for and collect records from separate offices; (2) the need to examine a voluminous amount of records required by the request; and (3) the need to consult with another agency or agency component. (See, 5 U.S.C. 552(a)(6)(B)(iii)). I have determined that processing of certain elements of your request meet the criteria allowed for such an extension.

You can rest assured that releasable materials will be made available at the earliest possible date and you can expect a further response to be sent out from this office by March 27, 2015.

Thank you for your patience. If you have any questions regarding the processing of your request, please contact me directly at (916) 557-7596.

Mr. Green,

I apologize for the confusion. We originally responded to your request on November 19, 2015. We combined the responsive documents for your two requests FA-15-0052 and FA-15-0052 since they pertained to the same project. I apologize that we did not make that clear in our response; however, I am sending a separate letter and DVD with the responsive records specifically for FA-15-0069 via FedEx today. Thank you.
