Pursuant to the Freedom of Information Act, I hereby request the following records:

(1) The contract between the Department and T-Mobile, USA allowing T-Mobile to build and maintain a 4G LTE network at the Naval Base in Guantanamo Bay, Cuba.

(2) Documentation outlining the construction and maintenance of the T-Mobile 4G LTE network at Guantanamo Bay.

(3) Any communications between the Department and T-Mobile, USA resulting from technical issues with any Services or Devices provided by T-Mobile, USA.

(4) Information in relation to bids from AT&T, Verizon, or T-Mobile, USA, for digital networks or Devices to be used on Navy properties.

If any of this information is deemed to fall under the nine Exemptions outlined by the Freedom of Information Act, please redact it using white boxes if possible, rather than withholding or cutting the information out.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Donna,

I am unsure if the Navy or the Navy Exchange would be the correct agency to request from in this instance. You can simplify the request to remove the request for documents pertaining to construction and maintenance of the network, and simply focus on the contract between T-Mobile USA and the Navy. MuckRock is a news agency that processes FOIA request for its members, and I therefore request news agency status.

I am writing to appeal for a review of the redactions made by the United States Navy to the Network Proposal between T-Mobile USA and the Department. I feel the redactions are quite excessive, and the supposed exempt information under Exemption (b)(4) of the Freedom of Information Act is already public knowledge, such as frequencies used by T-Mobile, cellular bands, cellular technologies, and general network information altogether.

If any of the redactions are removed as a result of this appeal, please send a new copy of the Network Proposal to me. Otherwise, please provide a new copy of the Network Proposal with each redaction citing an exemption used in the Freedom of Information Act.
