The National Institute of Allergy and Infectious Diseases (NIAID), National Institutes of Health (NIH) would like to provide an update on your NIH FOIA requests No. 60877 and No. 60878. These requests have been combined into one request, 60877. Please note, 60878 was closed.
Your request 60877 has been placed on-hold for fees and clarification related reasons.
Due to unusual circumstances, the request involves a "voluminous" amount of records that must be located, compiled, and reviewed, we are unable to process your request in the statutory required 20 working days and will need an extension of 10 working days.  Additionally, at this time, we have determined that more than 10,000 pages are necessary to respond to your request, and we will still charge all accrued fees at the completion of the processing of your request.
We would like to provide you with an opportunity to modify the scope of your request (revise search terms to less broad terms), narrow down email custodians to key decision-making personnel, and/or arrange an alternative time period for processing the request.  Please understand that the provided scope of custodians and search terms are going to delay processing by years and also result in a lot of unnecessary records that will be searched for relevancy and responsiveness.  We need more clarity on what records you seek to find, in order to provide materials sooner.

I would prefer you keep the two requests separate so that we may narrow them individually, but if you believe there are many duplicate emails, and it is easier for FOIA employees to handle, I am happy to break this request up into multiple individual requests later today.

Hello Mr. Riccio:

Thank you for your response. The FOIA office combined the two requests to insure processing times remain consistent for both searches. It’s our advisement to keep the requests combined as one.

Your response to my email, unfortunately, did not address the issues of the scope of your request. It’s our advisement that you withdraw FOIA request No. 60877 and resubmit a new request where you narrowly describe the scope. For example, only list key decision-making personnel from NIAID, provide a limited number of search terms that are not broad to eliminate email results that are voluminous, and provide a date range that is not broad in timeframe. Please understand that the current scope of email custodians and search terms that you provided in your initial request will delay processing by years and also result in a lot of unnecessary records that will be reviewed for relevancy and responsiveness. We need more clarity on what records you seek to find, in order to provide materials to you sooner.

If you insist on keeping 60877 as written, it will remain on a “fee-related hold” until we determine a monetary amount of pre-payment that you will need to pay in order to start processing your request.
