MuckRock News , DEPT MR 58313,

I am in receipt of your letter dated 17 September 2018, which arrived late yesterday through the U.S. Postal Service, wherein you request a status of your FOIA request, case number DON-NAVY-2018-009578.

I cannot explain the delay in your letter coming to the command, however, I suspect that our response to your request and your letter have crossed in the mail. We responded to your request on August 9, 2018. The response was delivered to your email box (the same one used for this email), as was preferred by you as stated in your request. However, I have provided it again in case it didn't make it to you the first time. Please acknowledge receipt when you get it.

I hope this email answers your question.

Sincerely,

Your request was answered and delivered electronically to this email box (as requested) on August 9, 2018. I then received an email from you on October 18, 2018 asking for an update. I responded that it was previously answered and electronically delivered on August 9th, 2018, but also resent the response at that time. I have now received yet another request for a status of that same request. Perhaps you'd like to provide a different email address where I can send the response? However, I'm hoping the third time is the charm. The response to your request is attached.

Sincerely,

From: U.s. Cyber Command

This email is in response to your request under the Freedom of Information Act (FOIA) request, dated July 17, 2018, for information pertaining to “copies of any and all powerpoint prsentations, memos, reports or other meetings notes related to the intelligence community's damage assessment concerning the so-called "ShadowBrokers" group - an entity that began leaking classified material in or around August 2016.  The documents I am requesting were authored in 2016 and 2017 by the NSA's Information Assurance Directorate and/or Central Security Service, but would have been circulated within U.S. Fleet Forces Command, National Cybersecurity and Communications Integration Center and Coast Guard - Office of Intelligence, among other federal agencies.”

After a thorough search of our files, it has been determined that Fleet Cyber Command has no records responsive to your request. It is recommended that you contact the National Security Agency regarding your request.  The documents referred to Fleet Cyber Command by Fleet Forces Command were determined to be non-responsive to your request because, although they use the term "Shadow Brokers," the documents are not a damage assessment from the requested time period, nor are they authoried by NSA's Information Assurance Directorate or CSS.  In addition, the referred documents are not damage assessments at all, regardless of authorship.

I am the official responsible for the denial of your request.  If you have any questions, please contact me at paul.a.walker@navy.mil.

You have the right to an appeal. It must be received within 90 calendar days from the date of this letter. Please provide a letter requesting an appeal, with a copy of your initial request and a copy of the letter of denial, in an envelope marked "Freedom of Information Act Appeal.”  You are encouraged (though not required) to provide an explanation why you believe the redactions were inappropriate or our search was inadequate. Also, please provide a copy of your appeal letter to us at FOIA Coordinator, U.S. Fleet Cyber Command, 9800 Savage Road, Suite 6586, Ft. Meade, MD 20755 or to paul.a.walker@navy.mil.

To ensure that your request is received by the deadline, I recommend that you make your appeal by using FOIAonline.  To do so, go to FOIAonline (a website which appears as the top item if you search the internet for “FOIAonline”), establish an account if you have not already (click “Create an Account,” the bottom of three green buttons on the right of the FOIAonline home page), locate your original request (enter a keyword or the tracking number of the request in the “Search for” field on the “Search” tab), click on the request, and then click on the "Create Appeal" tab in the left-hand column.  The basic information from your request will be duplicated for you, and you can type in the basis of your appeal.

Alternatively, you may mail your appeal to:

The Judge Advocate General (Code 14)

1322 Patterson Avenue SE, Suite 3000

Washington Navy Yard, DC 20374-5066

If you have any questions, please contact me paul.a.walker@navy.mil.   You may also contact the DON FOIA Public Liaison, Christopher Julka, at christopher.a.julka@navy.mil, (703)697-0031.
