Since 2008, the Department has experienced a 300 percent increase in the number of FOIA and Privacy Act requests it receives annually. In Fiscal Year (“FY”) 2015, the Department received nearly 25,000 FOIA and/or Privacy Act requests. To date, in FY 2016, the Department has received 8,500 FOIA and/or Privacy Act requests.

There has also been a marked increase in the number of FOIA lawsuits filed against the Department in recent years. The Department is currently engaged in over 100 FOIA litigation cases, many of which involve court-ordered document production schedules. This significant increase in the number of FOIA lawsuits is drawing on limited and already over-burdened resources and has necessitated the continued realignment of resources to meet court-imposed deadlines associated with this increase in litigation.
