Due to the increasing number of FOIA requests received by this office, we may encounter some delay in processing your request. Per Section 5.5(a) of the DHS FOIA regulations, 6 C.F.R. Part 5, ICE processes FOIA requests according to their order of receipt. Although ICE’s goal is to respond within 20 business days of receipt of your request, the FOIA does permit a 10- day extension of this time period. As your request seeks numerous documents that will necessitate a thorough and wide-ranging search, ICE will invoke a 10-day extension for your request, as allowed by Title 5 U.S.C. § 552(a)(6)(B). If you care to narrow the scope of your request, please contact our office. We will make every effort to comply with your request in a timely manner. I hereby appeal the legality of the agency's withholding.

An agency must comply with a FOIA request by issuing a determination within 20 business days after receipt of the request. 5 U.S.C. § 552(a)(6)(A)(i). The determination “must at least inform the requester of the scope of the documents that the agency will produce, as well as the scope of the documents that the agency plans to withhold under any FOIA exemptions.” Citizens for Responsibility & Ethics in Wash. v. Fed. Election Comm’n, 771 F.3d 180, 186 (D.C. Cir. 2013). An agency may be entitled to one ten-day extension of time to respond to a request if it provides written notice to the requester explaining that “unusual circumstances” exist
that warrant additional time. 5 U.S.C. § 552(a)(6)(B). An agency must immediately notify the requester of its determination whether to comply with a request, and the reasons for it, and of the right of such person to appeal an adverse determination. 5 U.S.C. § 552(a)(6)(B)(ii)

Further, the agency has imposed requirements for release of government records (i.e., a third-party release) that conflict with the plain language of the FOIA, which requires the agency to conduct an adequate search for and release all non-exempt records, including reasonably segregable portions of records containing information that may be subject to b6 or 7c.

Regardless, I emailed the agency a signed consent form from Mr. Zacarias Marroquin on January 28, 2020 and the request has been pending since then.

Please process this appeal within the period allowed by law and remand to the agency for re-tasking and re-processing consistent with the Act.
