To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of all responses sent to Congressional committees between Jan.1, 2008 and the date that this request is processed. These communications are stored together and should be easily accessible.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Michael Morisy

Hello Mr. Morisy,

This is in regard to the above refereneced FOIA request that you submitted to the Office of Inspector General (OIG), Department of Energy (DOE) on May 6, 2013, and your follow up status requests to OIG. In your request you asked for "a copy of all responses sent to Congressional committees between January 1, 2008 and the date that this request is processed." The OIG submitted your FOIA request to the DOE Headquarter FOIA Office, Office of Information Resource, on May 7, 2013, to be officially assigned to DOE and the OIG for action.

By the attached letter dated June 18, 2013, the DOE FOIA Officer informed you that MuckRock.com is not a news media organization. It is a commercial entity which provides a service at a cost and for purposes of assesment of fees, categorized MudRock as a "commercial use" requester. The letter also stated that your request for a waiver of all fees was denied and if you did not agreed with the determination you could appeal the determination within 30 calendar day.

Lastly, the FOIA Office asked that you provide an assurance that you agree to pay fees for the processing of the FOIA request by July 10, 2013, and if they did not hear from you or receive information by that date, no further action will be taken about the request.

If you have any questions about your FOIA request or the attached letter, you may contact the Headquarter FOIA Office on (202) 586-5955.
