To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

The agency's records related to Zeresenay Ermias Testfatsion, 34, who died while being deported to Eritrea after spending over a year in ICE Detention facilities.

Mr. Testfatsion had been in ICE custody since Feb. 2, 2017, following his arrest at a United States port of entry while attempting to apply for asylum in the United States. In October 2017, a federal immigration judge ordered Testfatsion removed from the U.S.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Matthew, this request was processed as FOIA 2018-35437 and closed on or about June 12, 2018. See "no records response" (attached).

However, we did some additional research and identified this individual's A-number. Therefore we have applied a new FOIA number 2018-43916 and have requested documents for review and release under this new number. We expect to have a response to you within 30 days.
