Pursuant to the Freedom of Information Act, I hereby request the following records:

DEA records concerning Anthony M. Scotto, who was president of the International Longshoreman's Association Local 1814. His date of birth was May 10, 1934; the first 5 digits of his Social Security Number are 088-24. He was also an inducted member of the Gambino family of Cosa Nostra, a known drug trafficking organization ("DTO").

Mr. Scotto is known to be deceased; please see attached PDF for published report of death. Records should be released as privacy interests are diminished post-mortem; further, release of records is in the public interest as Scotto was active in both politics and in organized crime and played an outsized role in the history of New York and the region's waterfronts.

"DEA Records" include records within the following systems of records (not exclusively): Automated Intelligence Records System (Pathfinder); Investigative Reporting and Filing System (IRFS); Grants of Confidentiality Files (GCF); Operations Files; Automated Records and Consolidated Orders System- Diversion Analysis and Detection System (ARCOS-DADS); Controlled Substances Act Registration Records (CSA); Registration Status-Investigation Records; and Security Files.

In addition, please return a result for a query of Narcotics and Dangerous Drugs Information System (NADDIS) pointer index to IRFS, using the aforementioned subject's name and (where necessary) accompanying identifying numbers and/or date of birth.

If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the DEA has no other copies of said records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I hope all is well. This email responds to your Freedom of Information Act/Privacy Act (FOIA/PA) request dated August 23, 2020, addressed to the Drug Enforcement Administration (DEA), Freedom of Information/Privacy Act Unit, seeking access to information regarding the above subject.

To process this request, we require proof of death. To the extent that non-public responsive records exist, without consent, proof of death, or an overriding public interest, disclosure of law enforcement records concerning an individual could reasonably be expected to constitute an unwarranted invasion of personal privacy. See 5 U.S.C. § 552(b)(7)(C). Because any non-public records responsive to your request would be categorically exempt from disclosure, this Office is not required to conduct a search for the requested records.

Acceptable forms of proof of death include obituaries, death certificates, recognized sources that can be documented, date of birth is 100 years or greater, or Social Security Index Page.
