Dear Mr. Free:

Thank you for submitting your Freedom of Information Act (FOIA) request to
the National Archives and Records Administration (NARA) via email to
foia@nara.gov. We received your request on February 6, 2024. Your request
concerns *a**ny records schedule communication from the Defense
Intelligence Agency’s Project Aquarius beginning in 1991 and ending in
1992.*

Our office handles FOIA and Privacy Act requests for NARA’s operational records
(records created by this agency). Because your FOIA request is for records
that may be archival records (records created by or originated in a
different agency but that may have been transferred to the legal custody of
NARA), we are forwarding it by this email to our Office of Research
Services, Textual Reference (RR2RR) staff who handle FOIA requests for
textual archival records.

That office will assign your request a tracking number and respond directly
to you. In the future, if you need to follow up with that office directly,
please contact them at the address below, or electronically via email
(email is preferred).

Office of Management and Budget (OMB), NARA had adjusted its normal
operations to balance the need of completing its mission-critical work
while also adhering to the recommended social distancing for the safety of

Dear Mr. Free:

This is in reply to your Freedom of Information Act (FOIA) request
concerning "any records communication from the Defense Intelligence
Agency's Project Aquarius beginning in 1991 and ending in 1992." Your
request was received by this office on February 6, 2024, and assigned case
number 24-22652.

Your request was forwarded to our office, the Archives 1 Reference Branch
(RR1R) in Washington, DC, for any "textual archival" records that relate to
your topic. However, the Office of General Counsel sent your request to us
by mistake. The Archives 1 Reference Branch holds the records of the U.S.
Army and War Department from 1775 to 1917 and the records of the U.S. Navy
and Marine Corps from 1775 to 1940. As such, our military records and
associated records schedules fall well outside the purview of your topic.

The records of the Defense Intelligence Agency are part of Record Group
373. That record group, along with most modern military records, are housed
at the National Archives at College Park, Maryland, specifically with the
Archives II Textual Reference Branch (RR2R). It appears that your
request was already forwarded to RR2R (archives2reference@nara.gov); you
should expect a reply directly from staff in that unit.

This completes the processing of your request. If you have any questions
about the records in the custody of the Archives 1 Reference Branch, please
email our office at archives1reference@nara.gov.

We do not consider this a denial of your Freedom of Information Act
request because we do not have the records of the Defense Intelligence
Agency (Record Group 373) in our custody. As such, your request was
forwarded by the Office of the General Counsel to our office by mistake. We
have provided you with information on the archival unit that does hold this
record group. Your request appears to have also been forwarded to that
unit; you will receive a reply from a staff member in the Archives II
Textual Reference Branch. However, if you are not satisfied with our action
on this request, your options for appeal and dispute resolution are
outlined in the attached document.

This concludes the processing of your request.

Sincerely,

Dear Mr. Free:

This email is in reply to your Freedom of Information Act request of
February 6, 2024, for records schedule communication from the Defense
Intelligence Agency’s Project Aquarius. It was received in our office on
February 7 and has the tracking number 24-22475.

Record Group 373 is the Records of the Defense Intelligence Agency (DIA).
Record Group 64, Records of the National Archives and Records
Administration, is where we may have paperwork dealing with the disposition
of records of DIA. UD-10D Entry 15, Office of Records Administration;
Records Appraisal and Disposition Division; External Disposition Case
Files, 1990-1999, includes appraisal records for Record Group 373 from the
period. However, a search of these records covering the entire decade was
unable to locate references to Project Aquarius. A search of UD-24D Entry
4, Agency Services; Office of the Chief Records Officer; External
Disposition Case Files for Inactive and Withdrawn Records Schedules, May 2,
1983-September 27, 2013, did not locate additional records for Record Group
373.

We do not consider this response a denial under the Freedom of Information
Act because the records in our custody do not include the information you
requested. However, if you are not satisfied with our action on this
request, your options for appeal and dispute resolution are outlined in the
enclosure. This concludes the processing of your request.
