Hello,
I am appealing the denial of this FOIL request. I am confident that the Enforcement Counsel maintains some records showing what penalties it has assessed and why it has done so. It is implausible either that those records do not exist or that providing them for a 2-3 year period would require an effort beyond what is reasonable according to FOIL statute. If the Enforcement Counsel has not assessed penalties over this time period, that information should be provided to me as an answer to my request.
I ask that the denial be reversed and these records provided to me on appeal.
